| 9 | 9 | | relating to a program under the Texas emissions reduction plan to |

| 10 | 10 | | reduce emissions from certain marine vessels. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 386.051(b-1), Health and Safety Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (b-1) Under the plan, the commission may establish and |
|---|
| 15 | 15 | | administer other programs, including other grants or funding |
|---|
| 16 | 16 | | programs, as determined by the commission to be necessary or |
|---|
| 17 | 17 | | effective in fulfilling its duties and achieving the objectives |
|---|
| 18 | 18 | | described under Section 386.052. The commission may apply the |
|---|
| 19 | 19 | | criteria and requirements applicable to the programs under |
|---|
| 20 | 20 | | Subsection (b) to programs established under this subsection, or |
|---|
| 21 | 21 | | the commission may establish separate criteria and requirements as |
|---|
| 22 | 22 | | necessary to achieve the commission's objectives. The additional |
|---|
| 23 | 23 | | programs shall be consistent with and comply with all applicable |
|---|
| 24 | 24 | | laws, regulations, and guidelines pertaining to the use of state |
|---|
| 25 | 25 | | funds, the awarding and administration of grants and contracts, and |
|---|
| 26 | 26 | | achieving reductions in ozone precursors or particulate matter. |
|---|
| 27 | 27 | | Under this subsection, the commission may place a priority on |
|---|
| 28 | 28 | | programs that address the following goals: |
|---|
| 29 | 29 | | (1) reduction of emissions of oxides of nitrogen or |
|---|
| 30 | 30 | | particulate matter from heavy-duty on-road vehicles and non-road |
|---|
| 31 | 31 | | equipment, including drayage vehicles, locomotives, and marine |
|---|
| 32 | 32 | | vessels, at seaport facilities or servicing seaport facilities in |
|---|
| 33 | 33 | | nonattainment areas; [and] |
|---|
| 34 | 34 | | (2) reduction of emissions from the operation of |
|---|
| 35 | 35 | | drilling, production, completions, and related heavy-duty on-road |
|---|
| 36 | 36 | | vehicles or non-road equipment in oil and gas production fields |
|---|
| 37 | 37 | | where the commission determines that the programs can help prevent |
|---|
| 38 | 38 | | that area or an adjacent area from being in violation of national |
|---|
| 39 | 39 | | ambient air quality standards; and |
|---|
| 40 | 40 | | (3) reduction of emissions from marine vessels |
|---|
| 41 | 41 | | operated by pilots engaged in pilot services, as those terms are |
|---|
| 42 | 42 | | defined by Section 61.002, Transportation Code. |
|---|
| 43 | 43 | | SECTION 2. This Act takes effect September 1, 2025. |
