77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a program under the Texas emissions reduction plan to
1010 reduce emissions from certain marine vessels.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 386.051(b-1), Health and Safety Code, is
1313 amended to read as follows:
1414 (b-1) Under the plan, the commission may establish and
1515 administer other programs, including other grants or funding
1616 programs, as determined by the commission to be necessary or
1717 effective in fulfilling its duties and achieving the objectives
1818 described under Section 386.052. The commission may apply the
1919 criteria and requirements applicable to the programs under
2020 Subsection (b) to programs established under this subsection, or
2121 the commission may establish separate criteria and requirements as
2222 necessary to achieve the commission's objectives. The additional
2323 programs shall be consistent with and comply with all applicable
2424 laws, regulations, and guidelines pertaining to the use of state
2525 funds, the awarding and administration of grants and contracts, and
2626 achieving reductions in ozone precursors or particulate matter.
2727 Under this subsection, the commission may place a priority on
2828 programs that address the following goals:
2929 (1) reduction of emissions of oxides of nitrogen or
3030 particulate matter from heavy-duty on-road vehicles and non-road
3131 equipment, including drayage vehicles, locomotives, and marine
3232 vessels, at seaport facilities or servicing seaport facilities in
3333 nonattainment areas; [and]
3434 (2) reduction of emissions from the operation of
3535 drilling, production, completions, and related heavy-duty on-road
3636 vehicles or non-road equipment in oil and gas production fields
3737 where the commission determines that the programs can help prevent
3838 that area or an adjacent area from being in violation of national
3939 ambient air quality standards; and
4040 (3) reduction of emissions from marine vessels
4141 operated by pilots engaged in pilot services, as those terms are
4242 defined by Section 61.002, Transportation Code.
4343 SECTION 2. This Act takes effect September 1, 2025.
