77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to certain civil penalties under the Deceptive Trade
1010 Practices-Consumer Protection Act.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 17.47(c), Business & Commerce Code, is
1313 amended to read as follows:
1414 (c) In addition to the request for a temporary restraining
1515 order, or permanent injunction in a proceeding brought under
1616 Subsection (a) of this section, the consumer protection division
1717 may request, and the trier of fact may award, a civil penalty to be
1818 paid to the state in an amount of:
1919 (1) not more than $20,000 [$10,000] per violation; and
2020 (2) an additional amount of not more than $250,000 if
2121 the act or practice that is the subject of the proceeding was
2222 calculated to acquire or deprive money or other property from a
2323 consumer who was:
2424 (A) 65 years of age or older when the act or
2525 practice occurred;
2626 (B) not fluent in the language in which the act or
2727 practice occurred; or
2828 (C) a person with an intellectual disability[, an
2929 additional amount of not more than $250,000].
3030 SECTION 2. The change in law made by this Act to Section
3131 17.47, Business & Commerce Code, applies only to an action brought
3232 under that section on or after the effective date of this Act. An
3333 action brought under Section 17.47, Business & Commerce Code,
3434 before the effective date of this Act is governed by the law in
3535 effect on the date the action was brought, and the former law is
3636 continued in effect for that purpose.
3737 SECTION 3. This Act takes effect September 1, 2025.
