66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to a local option election on the sale of alcoholic
99 beverages in certain areas of a municipality and the local
1010 regulation of premises in those areas.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 251.742, Alcoholic Beverage Code, is
1313 amended by amending Subsection (b) and adding Subsection (i) to
1414 read as follows:
1515 (b) This section applies only to a municipality that:
1616 (1) has a population of 15,000 or more[;] and
1717 [(2)] is located in two counties one of which:
1818 (A) has a population of 340,000 or more;
1919 (B) contains a municipality in which at least 85
2020 percent of the county's population resides; and
2121 (C) borders the Gulf of Mexico; or
2222 (2) has a population of 240,000 or more and:
2323 (A) is located in two or more counties; and
2424 (B) borders a man-made lake that has a surface
2525 area of at least 20,000 acres.
2626 (i) Subject to Chapter 211, Local Government Code, the
2727 governing body of the municipality may adopt zoning and land use
2828 regulations applicable to a premises that sells alcoholic
2929 beverages in the boundaries of a zone designated under this
3030 section.
3131 SECTION 2. This Act takes effect September 1, 2025.
