9 | 9 | beverages in certain areas of a municipality and the local | |
10 | 10 | regulation of premises in those areas. | |
11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 251.742, Alcoholic Beverage Code, is | |
13 | 13 | amended by amending Subsection (b) and adding Subsection (i) to | |
14 | 14 | read as follows: | |
15 | 15 | (b) This section applies only to a municipality that: | |
16 | 16 | (1) has a population of 15,000 or more[;] and | |
17 | 17 | [(2)] is located in two counties one of which: | |
18 | 18 | (A) has a population of 340,000 or more; | |
19 | 19 | (B) contains a municipality in which at least 85 | |
20 | 20 | percent of the county's population resides; and | |
21 | 21 | (C) borders the Gulf of Mexico; or | |
22 | 22 | (2) has a population of 240,000 or more and: | |
23 | 23 | (A) is located in two or more counties; and | |
24 | 24 | (B) borders a man-made lake that has a surface | |
25 | 25 | area of at least 20,000 acres. | |
26 | 26 | (i) Subject to Chapter 211, Local Government Code, the | |
27 | 27 | governing body of the municipality may adopt zoning and land use | |
28 | 28 | regulations applicable to a premises that sells alcoholic | |
29 | 29 | beverages in the boundaries of a zone designated under this | |
30 | 30 | section. | |
31 | 31 | SECTION 2. This Act takes effect September 1, 2025. |
