77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the regulation by the Railroad Commission of Texas of
1010 injection wells used to dispose of oil and gas waste; authorizing a
1111 fee.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 27.031, Water Code, is amended to read as
1414 follows:
1515 Sec. 27.031. PERMIT FROM RAILROAD COMMISSION; REPORT. (a)
1616 No person may continue using a disposal well or begin drilling a
1717 disposal well or converting an existing well into a disposal well to
1818 dispose of oil and gas waste without first obtaining a permit from
1919 the railroad commission.
2020 (b) The railroad commission shall require a permit holder to
2121 provide the commission with a daily report regarding:
2222 (1) the amount of produced water injected into the
2323 disposal well; and
2424 (2) the surface injection pressure data taken from the
2525 disposal well.
2626 SECTION 2. Subchapter C, Chapter 27, Water Code, is amended
2727 by adding Sections 27.0311 and 27.038 to read as follows:
2828 Sec. 27.0311. FEE. (a) For each injection well issued a
2929 permit, the railroad commission shall impose a fee of:
3030 (1) one cent per barrel of oil and gas waste injected
3131 if the oil and gas waste is produced within the commission oil and
3232 gas division district in which the injection well is located; or
3333 (2) ten cents per barrel of oil and gas waste injected
3434 if the oil and gas waste is not produced within the commission oil
3535 and gas division district in which the injection well is located.
3636 (b) A fee collected under Subsection (a) shall be deposited
3737 in the injection and abandoned wells cleanup fund under Section
3838 27.038.
3939 Sec. 27.038. INJECTION AND ABANDONED WELLS CLEANUP FUND.
4040 (a) The injection and abandoned wells cleanup fund is created as an
4141 account in the general revenue fund of the state treasury.
4242 (b) The fund consists of fees collected under Section
4343 27.0311.
4444 (c) Money in the injection and abandoned wells cleanup fund
4545 may be used by the railroad commission or its employees or agents
4646 only to fund projects related to researching:
4747 (1) the reuse and treatment for reuse of produced
4848 water; and
4949 (2) the surface remediation and plugging of abandoned
5050 wells.
5151 SECTION 3. This Act takes effect September 1, 2025.
