| 10 | 10 | | injection wells used to dispose of oil and gas waste; authorizing a |
|---|
| 11 | 11 | | fee. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 27.031, Water Code, is amended to read as |
|---|
| 14 | 14 | | follows: |
|---|
| 15 | 15 | | Sec. 27.031. PERMIT FROM RAILROAD COMMISSION; REPORT. (a) |
|---|
| 16 | 16 | | No person may continue using a disposal well or begin drilling a |
|---|
| 17 | 17 | | disposal well or converting an existing well into a disposal well to |
|---|
| 18 | 18 | | dispose of oil and gas waste without first obtaining a permit from |
|---|
| 19 | 19 | | the railroad commission. |
|---|
| 20 | 20 | | (b) The railroad commission shall require a permit holder to |
|---|
| 21 | 21 | | provide the commission with a daily report regarding: |
|---|
| 22 | 22 | | (1) the amount of produced water injected into the |
|---|
| 23 | 23 | | disposal well; and |
|---|
| 24 | 24 | | (2) the surface injection pressure data taken from the |
|---|
| 25 | 25 | | disposal well. |
|---|
| 26 | 26 | | SECTION 2. Subchapter C, Chapter 27, Water Code, is amended |
|---|
| 27 | 27 | | by adding Sections 27.0311 and 27.038 to read as follows: |
|---|
| 28 | 28 | | Sec. 27.0311. FEE. (a) For each injection well issued a |
|---|
| 29 | 29 | | permit, the railroad commission shall impose a fee of: |
|---|
| 30 | 30 | | (1) one cent per barrel of oil and gas waste injected |
|---|
| 31 | 31 | | if the oil and gas waste is produced within the commission oil and |
|---|
| 32 | 32 | | gas division district in which the injection well is located; or |
|---|
| 33 | 33 | | (2) ten cents per barrel of oil and gas waste injected |
|---|
| 34 | 34 | | if the oil and gas waste is not produced within the commission oil |
|---|
| 35 | 35 | | and gas division district in which the injection well is located. |
|---|
| 36 | 36 | | (b) A fee collected under Subsection (a) shall be deposited |
|---|
| 37 | 37 | | in the injection and abandoned wells cleanup fund under Section |
|---|
| 38 | 38 | | 27.038. |
|---|
| 39 | 39 | | Sec. 27.038. INJECTION AND ABANDONED WELLS CLEANUP FUND. |

| 40 | 40 | | (a) The injection and abandoned wells cleanup fund is created as an |
|---|
| 41 | 41 | | account in the general revenue fund of the state treasury. |
|---|
| 42 | 42 | | (b) The fund consists of fees collected under Section |
|---|
| 43 | 43 | | 27.0311. |
|---|
| 44 | 44 | | (c) Money in the injection and abandoned wells cleanup fund |
|---|
| 45 | 45 | | may be used by the railroad commission or its employees or agents |
|---|
| 46 | 46 | | only to fund projects related to researching: |
|---|
| 47 | 47 | | (1) the reuse and treatment for reuse of produced |
|---|
| 48 | 48 | | water; and |
|---|
| 49 | 49 | | (2) the surface remediation and plugging of abandoned |
|---|
| 50 | 50 | | wells. |
|---|
| 51 | 51 | | SECTION 3. This Act takes effect September 1, 2025. |
