77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a certificate of public convenience and necessity to
1010 construct an electric transmission line.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 37.052(c), Utilities Code, is amended to
1313 read as follows:
1414 (c) An electric utility is not required to amend the
1515 utility's certificate of public convenience and necessity to
1616 construct a transmission line that connects the utility's existing
1717 transmission facilities to a substation or metering point if:
1818 (1) the transmission line does not exceed:
1919 (A) five [three] miles in length, if the line
2020 connects to a load-serving substation or metering point; or
2121 (B) two miles in length, if the line connects to a
2222 generation substation or metering point;
2323 (2) each landowner whose property would be directly
2424 affected by the transmission line, as provided by commission rules,
2525 provides written consent for the transmission line; and
2626 (3) all rights-of-way necessary for construction of
2727 the transmission line have been purchased.
2828 SECTION 2. This Act takes effect September 1, 2025.
