88 AN ACT
99 relating to damage liability for a collision with a motorist who
1010 failed to establish financial responsibility.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 72, Civil Practice and Remedies Code, is
1313 amended by adding Subchapter C to read as follows:
1414 SUBCHAPTER C. LIABILITY FOR COLLISION WITH CERTAIN MOTOR VEHICLE
1515 OWNERS AND OPERATORS
1616 Sec. 72.101. DEFINITIONS. In this subchapter:
1717 (1) "Financial responsibility" has the meaning
1818 assigned by Section 601.002, Transportation Code.
1919 (2) "Noneconomic damages" means costs for physical and
2020 emotional pain and suffering, physical impairment, emotional
2121 distress, mental anguish, loss of enjoyment, loss of companionship,
2222 services, and consortium, and any other nonpecuniary loss
2323 proximately caused by a motor vehicle collision. The term does not
2424 include:
2525 (A) treatment and rehabilitation;
2626 (B) medical expenses;
2727 (C) loss of economic or educational potential;
2828 (D) loss of productivity;
2929 (E) absenteeism;
3030 (F) support expenses;
3131 (G) accidents or injury; and
3232 (H) any other pecuniary loss proximately caused
3333 by a motor vehicle collision.
3434 Sec. 72.102. PROHIBITED RECOVERY OF CERTAIN DAMAGES. (a)
3535 Except as provided by Section 72.103, an individual may not recover
3636 damages for bodily injury, death, or property damage or noneconomic
3737 damages sustained as a result of a motor vehicle collision for which
3838 the individual failed to establish financial responsibility in
3939 accordance with Chapter 601, Transportation Code.
4040 (b) Except as provided by Section 72.103, the personal
4141 representative of an individual described by Subsection (a) who
4242 died as a result of a motor vehicle collision may not recover
4343 damages described by Subsection (a) in a wrongful death action
4444 brought under Subchapter A, Chapter 71, for the individual's death.
4545 Sec. 72.103. EXCEPTIONS. Section 72.102 does not apply to:
4646 (1) an individual who:
4747 (A) at the time of the collision on which the
4848 action is based had failed to establish financial responsibility in
4949 accordance with Chapter 601, Transportation Code, for a period of
5050 not more than 45 days; and
5151 (B) before the period described by Paragraph (A),
5252 had continuously established financial responsibility in
5353 accordance with Chapter 601, Transportation Code, for at least one
5454 year;
5555 (2) an individual who, at the time of the collision on
5656 which the action is based:
5757 (A) was a passenger in a vehicle and was not the
5858 owner or operator of the vehicle for which financial responsibility
5959 was not established;
6060 (B) was a minor under the age of 18; or
6161 (C) was an active-duty member of the armed forces
6262 of the United States who had returned from a deployment not more
6363 than six months earlier; or
6464 (3) damages caused by an individual who at the time of
6565 the collision on which the action is based:
6666 (A) was driving while under the influence of
6767 alcohol or a controlled substance;
6868 (B) caused the collision intentionally,
6969 recklessly, or with gross negligence;
7070 (C) improperly fled from the scene of the
7171 collision; or
7272 (D) was acting in furtherance of an offense or in
7373 immediate flight from an offense that constitutes a felony.
7474 SECTION 2. The limitation of liability for noneconomic
7575 damages provided by Subchapter C, Chapter 72, Civil Practice and
7676 Remedies Code, as added by this Act, is an exercise of authority
7777 under Section 66(c), Article III, Texas Constitution, and takes
7878 effect only if this Act receives a vote of three-fifths of all the
7979 members elected to each house, as provided by Subsection (e) of that
8080 section.
8181 SECTION 3. Subchapter C, Chapter 72, Civil Practice and
8282 Remedies Code, as added by this Act, applies only to a cause of
8383 action that accrues on or after the effective date of this Act.
8484 SECTION 4. This Act takes effect September 1, 2025.
