| 12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 13 | 13 | SECTION 1. Section 11.174, Education Code, is amended by | |
| 14 | 14 | adding Subsection (c-1) to read as follows: | |
| 15 | 15 | (c-1) Before entering into a contract as provided by this | |
| 16 | 16 | section with the governing body of an open-enrollment charter | |
| 17 | 17 | school operated by a charter holder not located in this state or | |
| 18 | 18 | with an entity not located in this state, the board of trustees of a | |
| 19 | 19 | school district must consider the contract at an open meeting and | |
| 20 | 20 | vote to enter into the contract by a record vote. | |
| 21 | 21 | SECTION 2. The change in law made by this Act applies only | |
| 22 | 22 | to a contract that is entered into on or after the effective date of | |
| 23 | 23 | this Act. A contract entered into before the effective date of this | |
| 24 | 24 | Act is governed by the law as it existed immediately before the | |
| 25 | 25 | effective date of this Act, and that law is continued in effect for | |
| 26 | 26 | that purpose. | |
| 27 | 27 | SECTION 3. This Act takes effect September 1, 2025. |
