11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 16.053, Water Code, is amended by adding | |
13 | 13 | Subsection (e-3) to read as follows: | |
14 | 14 | (e-3) When developing a regional water plan under | |
15 | 15 | Subsection (e), a regional water planning group for an area that is | |
16 | 16 | largely dependent on surface water from one or more reservoirs may | |
17 | 17 | evaluate the availability of water from a reservoir based on an | |
18 | 18 | analysis of the reservoir's safe yield, expressed in terms of a | |
19 | 19 | reduced annual water volume that would continue to be available | |
20 | 20 | from the reservoir for a period longer than that of a drought of | |
21 | 21 | record. A planning group described by this subsection that decides | |
22 | 22 | not to use a safe yield analysis in developing its regional water | |
23 | 23 | plan shall provide in its plan an explanation of the reason for that | |
24 | 24 | decision. | |
25 | 25 | SECTION 2. This Act takes effect September 1, 2025. |
