| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Section 8838.106(b), Special District Local Laws | |
| 13 | 13 | Code, is amended to read as follows: | |
| 14 | 14 | (b) The district may not: | |
| 15 | 15 | (1) require the owner of a well used solely for | |
| 16 | 16 | domestic or livestock purposes that is exempt from permitting under | |
| 17 | 17 | Section 36.117(b)(1), Water Code, to install a meter or measuring | |
| 18 | 18 | device on the well; | |
| 19 | 19 | (2) sell, transport, or export groundwater outside of | |
| 20 | 20 | the district; or | |
| 21 | 21 | (3) enter into a contract or engage in an action to | |
| 22 | 22 | supply water to any person in the service area of any municipality | |
| 23 | 23 | or retail public utility located in the district, except with the | |
| 24 | 24 | consent of the municipality or retail public utility. | |
| 25 | 25 | SECTION 2. This Act takes effect immediately if it receives | |
| 26 | 26 | a vote of two-thirds of all the members elected to each house, as | |
| 27 | 27 | provided by Section 39, Article III, Texas Constitution. If this | |
| 28 | 28 | Act does not receive the vote necessary for immediate effect, this | |
| 29 | 29 | Act takes effect September 1, 2025. |
