77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a prohibition on certain herbicides and food and
1010 beverage additives; authorizing a civil penalty.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter G, Chapter 76, Agriculture Code, is
1313 amended by adding Section 76.1415 to read as follows:
1414 Sec. 76.1415. PROHIBITED HERBICIDES. The department shall
1515 prohibit the sale, distribution, and application of the following
1616 herbicides:
1717 (1) chloropropham;
1818 (2) glyphosate; and
1919 (3) dicamba.
2020 SECTION 2. Subchapter B, Chapter 431, Health and Safety
2121 Code, is amended by adding Section 431.024 to read as follows:
2222 Sec. 431.024. PROHIBITION ON SALE OF FOOD OR BEVERAGE
2323 CONTAINING CERTAIN ADDITIVES. (a) A person may not sell in this
2424 state any food, including a beverage, intended for human
2525 consumption that contains the following substances:
2626 (1) aspartame;
2727 (2) artificial flavoring;
2828 (3) propylparaben;
2929 (4) azodicarbonamide (ADA);
3030 (5) butylated hydroxyanisole (BHA);
3131 (6) butylated hydroxytoluene (BHT);
3232 (7) color additive;
3333 (8) dimethylpolysiloxane (PDMS);
3434 (9) monosodium glutamate (MSG);
3535 (10) tert-butylhydroquinone (TBHQ);
3636 (11) partially hydrogenated oils;
3737 (12) sodium benzoate;
3838 (13) sodium nitrate;
3939 (14) sodium nitrite; or
4040 (15) methylparaben.
4141 (b) A person who violates Subsection (a) is liable for a
4242 civil penalty in an amount not to exceed $500 for each violation.
4343 Each item sold constitutes a separate violation. The attorney
4444 general may file suit in district court to recover a civil penalty
4545 imposed under this section.
4646 (c) A civil penalty collected under this section shall be
4747 deposited in the general revenue fund.
4848 (d) The attorney general may recover reasonable expenses
4949 incurred in collecting the civil penalty, including investigative
5050 costs, court costs, reasonable attorney's fees, witness fees, and
5151 deposition expenses.
5252 SECTION 3. This Act takes effect September 1, 2025.
