9 | 9 | | relating to a prohibition on certain herbicides and food and |

10 | 10 | | beverage additives; authorizing a civil penalty. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter G, Chapter 76, Agriculture Code, is |
---|
13 | 13 | | amended by adding Section 76.1415 to read as follows: |
---|
14 | 14 | | Sec. 76.1415. PROHIBITED HERBICIDES. The department shall |
---|
15 | 15 | | prohibit the sale, distribution, and application of the following |
---|
16 | 16 | | herbicides: |
---|
17 | 17 | | (1) chloropropham; |
---|
18 | 18 | | (2) glyphosate; and |
---|
19 | 19 | | (3) dicamba. |
---|
20 | 20 | | SECTION 2. Subchapter B, Chapter 431, Health and Safety |
---|
21 | 21 | | Code, is amended by adding Section 431.024 to read as follows: |
---|
22 | 22 | | Sec. 431.024. PROHIBITION ON SALE OF FOOD OR BEVERAGE |
---|
23 | 23 | | CONTAINING CERTAIN ADDITIVES. (a) A person may not sell in this |
---|
24 | 24 | | state any food, including a beverage, intended for human |
---|
25 | 25 | | consumption that contains the following substances: |
---|
26 | 26 | | (1) aspartame; |
---|
27 | 27 | | (2) artificial flavoring; |
---|
28 | 28 | | (3) propylparaben; |
---|
29 | 29 | | (4) azodicarbonamide (ADA); |
---|
30 | 30 | | (5) butylated hydroxyanisole (BHA); |
---|
31 | 31 | | (6) butylated hydroxytoluene (BHT); |
---|
32 | 32 | | (7) color additive; |
---|
33 | 33 | | (8) dimethylpolysiloxane (PDMS); |
---|
34 | 34 | | (9) monosodium glutamate (MSG); |
---|
35 | 35 | | (10) tert-butylhydroquinone (TBHQ); |
---|
36 | 36 | | (11) partially hydrogenated oils; |
---|
37 | 37 | | (12) sodium benzoate; |
---|
38 | 38 | | (13) sodium nitrate; |
---|
39 | 39 | | (14) sodium nitrite; or |
---|
40 | 40 | | (15) methylparaben. |
---|
41 | 41 | | (b) A person who violates Subsection (a) is liable for a |
---|
42 | 42 | | civil penalty in an amount not to exceed $500 for each violation. |
---|
43 | 43 | | Each item sold constitutes a separate violation. The attorney |
---|
44 | 44 | | general may file suit in district court to recover a civil penalty |
---|
45 | 45 | | imposed under this section. |
---|
46 | 46 | | (c) A civil penalty collected under this section shall be |
---|
47 | 47 | | deposited in the general revenue fund. |
---|
48 | 48 | | (d) The attorney general may recover reasonable expenses |
---|
49 | 49 | | incurred in collecting the civil penalty, including investigative |
---|
50 | 50 | | costs, court costs, reasonable attorney's fees, witness fees, and |
---|
51 | 51 | | deposition expenses. |
---|
52 | 52 | | SECTION 3. This Act takes effect September 1, 2025. |
