77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of a county overlying the Edwards Aquifer
1010 to approve the creation of and issuance of bonds by a municipal
1111 utility district.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 54.001, Water Code, is amended by adding
1414 Subdivision (10) to read as follows:
1515 (10) "Edwards Aquifer" has the meaning assigned by
1616 Section 26.046.
1717 SECTION 2. Section 54.0161(a), Water Code, is amended to
1818 read as follows:
1919 (a) This section applies only to a proposed district:
2020 (1) all of which is to be located outside the corporate
2121 limits of a municipality; and
2222 (2) no part of which is to be located in a county that
2323 contains a portion of the Edwards Aquifer.
2424 SECTION 3. Subchapter B, Chapter 54, Water Code, is amended
2525 by adding Section 54.0166 to read as follows:
2626 Sec. 54.0166. NOTICE AND CONSENT OF COUNTY FOR DISTRICT
2727 OVERLYING EDWARDS AQUIFER. (a) This section applies only to a
2828 proposed district:
2929 (1) all of which is to be located outside the corporate
3030 limits of a municipality; and
3131 (2) any part of which is to be located in a county that
3232 contains a portion of the Edwards Aquifer.
3333 (b) Promptly after a petition is filed with the commission
3434 to create a district to which this section applies, the commission
3535 shall notify the commissioners court of any county in which the
3636 proposed district is to be located.
3737 (c) The commissioners court of a county in which the
3838 proposed district is to be located may review the petition for
3939 creation and other evidence and information relating to the
4040 proposed district that the commissioners consider necessary.
4141 Petitioners for the creation of a district shall submit to the
4242 county commissioners court any relevant information requested by
4343 the commissioners court.
4444 (d) A proposed district may not be created and include land
4545 in a county to which this section applies unless the commissioners
4646 court of the county adopts a measure by majority vote stating that
4747 the county does not object to the inclusion of the land in the
4848 district. The commission by rule may adopt a deadline for the
4949 commissioners court of a county to object to the creation of a
5050 district for the purposes of this section. The commission may not
5151 approve a petition to create a district to which this section
5252 applies if the commissioners court of the county objects under this
5353 subsection.
5454 (e) The commissioners court of a county may request from the
5555 commission any information necessary for the purposes of this
5656 section.
5757 SECTION 4. Section 54.5161, Water Code, is amended by
5858 amending Subsection (a) and adding Subsection (c) to read as
5959 follows:
6060 (a) Except as provided by Subsection (c), before [Before]
6161 the commission gives final approval on any bond issue for the
6262 purpose of financing a project of a district located wholly or
6363 partly outside the extraterritorial jurisdiction of a city, the
6464 commission shall notify the county commissioners of the county in
6565 which the district is located that an application has been filed and
6666 give the county an opportunity within 30 days after notification to
6767 examine all information on file and submit a written opinion from
6868 the commissioners court stating any findings, conclusions, or other
6969 information that the commissioners court considers important to the
7070 commission's final determination.
7171 (c) Before the commission gives final approval on any bond
7272 issue for the purpose of financing a project of a district to which
7373 Section 54.0166 applies, in addition to the requirements of
7474 Subsections (a) and (b), the commission shall provide the
7575 commissioners court of the county an opportunity to reject the bond
7676 issue through a measure adopted by a majority vote of the
7777 commissioners court. The commissioners court of a county may
7878 request from the commission any information necessary for the
7979 purposes of this section. The commission may not give final
8080 approval to a bond issue rejected by the commissioners court of a
8181 county under this subsection.
8282 SECTION 5. (a) Section 54.0166, Water Code, as added by
8383 this Act, applies only to a petition for the creation of a municipal
8484 utility district filed with the Texas Commission on Environmental
8585 Quality on or after the effective date of this Act. A petition for
8686 the creation of a municipal utility district filed with the Texas
8787 Commission on Environmental Quality before the effective date of
8888 this Act is governed by the law in effect on the date the petition
8989 was filed, and the former law is continued in effect for that
9090 purpose.
9191 (b) Section 54.0166, Water Code, as added by this Act, does
9292 not affect the validity of a municipal utility district created by
9393 the Texas Commission on Environmental Quality before the effective
9494 date of this Act.
9595 (c) Section 54.5161, Water Code, as amended by this Act,
9696 applies only to an application submitted to the Texas Commission on
9797 Environmental Quality under that section on or after the effective
9898 date of this Act. An application submitted to the Texas Commission
9999 on Environmental Quality under Section 54.5161, Water Code, before
100100 the effective date of this Act is governed by the law in effect on
101101 that date, and the former law is continued in effect for that
102102 purpose.
103103 SECTION 6. This Act takes effect September 1, 2025.
