88 AN ACT
99 relating to eligibility for supplemental nutrition assistance
1010 program benefits.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 33, Human Resources Code,
1313 is amended by adding Section 33.016 to read as follows:
1414 Sec. 33.016. PERIOD OF ELIGIBILITY OF CERTAIN PERSONS FOR
1515 SNAP BENEFITS. (a) The commission by rule shall ensure that an
1616 individual whose eligibility for supplemental nutrition assistance
1717 program benefits has been initially established or recertified
1818 remains eligible to receive those benefits for a period of 12
1919 months.
2020 (b) The commission may adjust the eligibility period
2121 described by Subsection (a) as necessary to align an individual's
2222 recertification of eligibility for supplemental nutrition
2323 assistance program benefits with the redetermination of
2424 eligibility of a child residing in the same household for medical
2525 assistance program benefits under Chapter 32.
2626 (c) This section does not apply to an individual receiving
2727 supplemental nutrition assistance program benefits who:
2828 (1) at the time the individual's eligibility for
2929 benefits is initially established or recertified, expects a change
3030 in circumstances within six months following the establishment or
3131 recertification of eligibility that will make the individual
3232 ineligible to receive the benefits;
3333 (2) is 60 years of age or older or has a disability,
3434 has no earned income, and resides in a household in which every
3535 other individual residing in the household:
3636 (A) is 60 years of age or older or has a
3737 disability; and
3838 (B) has no earned income; or
3939 (3) resides in a household in which at least one
4040 individual:
4141 (A) is at least 18 years of age but younger than
4242 50 years of age;
4343 (B) has no dependents; and
4444 (C) does not have a disability.
4545 SECTION 2. The change in law made by this Act applies to an
4646 initial determination or recertification of eligibility of an
4747 individual for the supplemental nutrition assistance program under
4848 Chapter 33, Human Resources Code, that is made on or after the
4949 effective date of this Act.
5050 SECTION 3. If before implementing any provision of this Act
5151 a state agency determines that a waiver or authorization from a
5252 federal agency is necessary for implementation of that provision,
5353 the agency affected by the provision shall request the waiver or
5454 authorization and may delay implementing that provision until the
5555 waiver or authorization is granted.
5656 SECTION 4. This Act takes effect September 1, 2025.
