| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Sections 43.031(a) and (e), Election Code, are | |
| 13 | 13 | amended to read as follows: | |
| 14 | 14 | (a) In this subchapter:[,] | |
| 15 | 15 | (1) "Institution of higher education" has the meaning | |
| 16 | 16 | assigned by Section 61.003, Education Code. | |
| 17 | 17 | (2) "Public [public] building" means a building owned | |
| 18 | 18 | or controlled by the state or a political subdivision. | |
| 19 | 19 | (e) A polling place may not be located: | |
| 20 | 20 | (1) on a campus of a public primary or secondary school | |
| 21 | 21 | or institution of higher education, unless the campus is closed for | |
| 22 | 22 | operation during the period for voting; or | |
| 23 | 23 | (2) at the residence of a person who is: | |
| 24 | 24 | (A) [(1)] a candidate for an elective office, | |
| 25 | 25 | including an office of a political party; or | |
| 26 | 26 | (B) [(2)] related within the third degree by | |
| 27 | 27 | consanguinity or the second degree by affinity, as determined under | |
| 28 | 28 | Chapter 573, Government Code, to a candidate described by Paragraph | |
| 29 | 29 | (A) [Subdivision (1)]. | |
| 30 | 30 | SECTION 2. This Act takes effect September 1, 2025. |
