| 9 | 9 | | relating to the display of the pledge of allegiance to the United |

| 10 | 10 | | States flag and the pledge of allegiance to the Texas flag in public |
|---|
| 11 | 11 | | school classrooms. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 25.082, Education Code, is amended by |
|---|
| 14 | 14 | | amending Subsection (b-1) and adding Subsection (b-2) to read as |
|---|
| 15 | 15 | | follows: |
|---|
| 16 | 16 | | (b-1) The board of trustees of each school district and the |
|---|
| 17 | 17 | | governing board of each open-enrollment charter school shall |
|---|
| 18 | 18 | | require that: |
|---|
| 19 | 19 | | (1) the United States and Texas flags be prominently |
|---|
| 20 | 20 | | displayed in accordance with 4 U.S.C. Sections 5-10 and Chapter |
|---|
| 21 | 21 | | 3100, Government Code, in each campus classroom to which a student |
|---|
| 22 | 22 | | is assigned at the time the pledges of allegiance to those flags are |
|---|
| 23 | 23 | | recited; and |
|---|
| 24 | 24 | | (2) the text of the pledges of allegiance to the United |
|---|
| 25 | 25 | | States flag and the Texas flag as provided by 4 U.S.C. Section 4 and |
|---|
| 26 | 26 | | Section 3100.101, Government Code, be prominently displayed in each |
|---|
| 27 | 27 | | classroom. |
|---|
| 28 | 28 | | (b-2) A district or school is not required to spend federal, |
|---|
| 29 | 29 | | state, or local district or school funds to acquire flags or |
|---|
| 30 | 30 | | displays required under Subsection (b-1) [this subsection]. A |
|---|
| 31 | 31 | | district or school may raise money or accept gifts, grants, and |
|---|
| 32 | 32 | | donations to acquire flags or displays required under Subsection |
|---|
| 33 | 33 | | (b-1) [this subsection]. |
|---|
| 34 | 34 | | SECTION 2. The change in law made by this Act applies |
|---|
| 35 | 35 | | beginning with the 2025-2026 school year. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 40 | 40 | | Act takes effect September 1, 2025. |
