88 AN ACT
99 relating to hiring and employment requirements for persons in
1010 direct contact with children at certain facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle D, Title 9, Health and Safety Code, is
1313 amended by adding Chapter 811 to read as follows:
1414 CHAPTER 811. EMPLOYMENT REQUIREMENTS FOR CERTAIN FACILITIES TO
1515 PREVENT PHYSICAL OR SEXUAL ABUSE OF CHILDREN
1616 Sec. 811.001. DEFINITIONS. In this chapter:
1717 (1) "Commission" means the Health and Human Services
1818 Commission.
1919 (2) "Department" means the Texas Juvenile Justice
2020 Department.
2121 (3) "Facility" means:
2222 (A) a residential treatment facility or group
2323 home licensed or otherwise regulated by the commission;
2424 (B) a juvenile detention facility regulated by
2525 the department; or
2626 (C) a shelter operated by or under the authority
2727 of a county or municipality that provides temporary living
2828 accommodations for individuals who are homeless.
2929 Sec. 811.002. APPLICABILITY. This chapter applies only to
3030 the following governmental entities:
3131 (1) the commission;
3232 (2) the department;
3333 (3) a county; and
3434 (4) a municipality.
3535 Sec. 811.003. REQUIRED CRIMINAL HISTORY RECORD INFORMATION
3636 REVIEW AND EMPLOYMENT VERIFICATION. (a) A governmental entity to
3737 which this chapter applies shall ensure each facility the entity
3838 regulates or operates reviews state and federal criminal history
3939 record information and conducts an employment verification for each
4040 person:
4141 (1) who is:
4242 (A) an applicant for employment with the
4343 facility;
4444 (B) an employee of the facility;
4545 (C) an applicant for a volunteer position with
4646 the facility;
4747 (D) a volunteer with the facility;
4848 (E) an applicant for an independent contractor
4949 position with the facility; or
5050 (F) an independent contractor of the facility;
5151 and
5252 (2) who may be placed in direct contact with a child
5353 receiving services at the facility.
5454 (b) For purposes of Subsection (a)(2), a person may be
5555 placed in direct contact with a child if the person's position
5656 potentially requires the person to:
5757 (1) provide care, supervision, or guidance to a child;
5858 (2) exercise any form of control over a child; or
5959 (3) routinely interact with a child.
6060 (c) In conducting an employment verification under
6161 Subsection (a), the facility must at a minimum contact the previous
6262 employers listed in the submitted application materials for each
6363 applicant.
6464 (d) Each facility shall obtain electronic updates from the
6565 Department of Public Safety of arrests and convictions for each
6666 person:
6767 (1) described by Subsection (a)(1)(B), (D), or (F);
6868 and
6969 (2) who continues as an employee, volunteer, or
7070 independent contractor or who otherwise continues to be placed in
7171 direct contact with a child at the facility.
7272 Sec. 811.004. EFFECT OF CERTAIN CRIMINAL CONVICTIONS OR
7373 CHILD ABUSE ALLEGATIONS. (a) A facility may not offer a person an
7474 employment, volunteer, or independent contractor position and must
7575 terminate the person's position if, based on a criminal history
7676 record information review or an employment verification of that
7777 person, the facility discovers the person:
7878 (1) engaged in physical or sexual abuse of a child
7979 constituting an offense under Section 21.02, 22.011, 22.021, or
8080 25.02, Penal Code; or
8181 (2) was terminated from a previous position based on
8282 allegations of engaging in conduct described by Subdivision (1).
8383 (b) A separation agreement for a facility employee,
8484 volunteer, or independent contractor may not include a provision
8585 that prohibits disclosure to a prospective employer of an
8686 allegation of conduct constituting an offense under Section 21.02,
8787 22.011, 22.021, or 25.02, Penal Code.
8888 Sec. 811.005. TRAINING REQUIREMENTS. A facility must
8989 provide training to each employee, volunteer, or independent
9090 contractor who may be placed in direct contact with a child. The
9191 training must include:
9292 (1) recognition of the signs of physical and sexual
9393 abuse and reporting requirements for suspected physical and sexual
9494 abuse;
9595 (2) the facility's policies related to reporting of
9696 physical and sexual abuse; and
9797 (3) methods for maintaining professional and
9898 appropriate relationships with children.
9999 SECTION 2. Section 811.004(b), Health and Safety Code, as
100100 added by this Act, applies only to an agreement entered into on or
101101 after the effective date of this Act.
102102 SECTION 3. This Act takes effect September 1, 2025.
