108 AN ACT
119 relating to imposition of application fees for certain permits and
1210 permit amendments for the disposal of oil and gas waste.
1311 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1412 SECTION 1. Section 91.1013, Natural Resources Code, is
1513 amended by amending Subsections (a) and (b) and adding Subsection
1614 (a-1) to read as follows:
1715 (a) [With each application for a fluid injection well
1816 permit, the applicant shall submit to the commission a
1917 nonrefundable fee of $200.] In this section:
20- (1) "Commercial oil and gas waste separation facility"
21- means a facility that manages but does not dispose of oil and gas
22- waste on site and that is managed by an owner or operator whose
23- primary business is to provide oil field fluid or oil and gas waste
24- management services for compensation.
25- (2) "Commercial surface oil and gas waste disposal
26- facility" means a facility that disposes of oil and gas waste on
27- site and that is managed by an owner or operator whose primary
28- business is to provide oil field fluid or oil and gas waste disposal
29- services for compensation.
30- (3) "Fluid[, "fluid] injection well" means any well

3119 used to inject fluid or gas into the ground in connection with the
3220 exploration or production of oil or gas other than an oil and gas
3321 waste disposal well regulated by the commission pursuant to Chapter
3422 27, Water Code.
35- (4) "Land application permit" means a permit

3624 authorizing the covering of a controlled area with gas plant
3725 effluent or low-chloride produced water through the use of a
3826 sprinkler or other irrigation system.
39- (5) "Landfarm permit" means a permit authorizing the
40- disposal of low-chloride, water-based oil and gas waste, including
41- drilling fluid, by mixing or tilling the fluid or waste into the
42- natural soil so that the waste will not migrate from the area
43- covered by the landfarm permit.
44- (6) "Landtreatment permit" means a permit authorizing
45- the disposal of oil-based oil and gas waste, including oil-based
46- drilling fluid, oil-impacted soil, or other oil and gas waste, by
47- mixing or tilling the fluid, soil, or waste into the natural soil to
48- degrade the fluid, impacted soil, or waste so that the fluid,
49- impacted soil, or waste will not migrate from the area covered by
50- the landtreatment permit.
27+ (3) "Landfarm permit" means a permit authorizing the
28+ disposal of low chloride, water-based drilling fluid or oil and gas
29+ waste by mixing or tilling the fluid or waste into the natural soil
30+ so that the waste will not migrate from the area covered by the
31+ landfarm permit.
32+ (4) "Landtreatment permit" means a permit authorizing
33+ the disposal of oil-based drilling fluid, oil-impacted soil, or oil
34+ and gas waste by mixing or tilling the fluid, soil, or waste into
35+ the natural soil to degrade the fluid, impacted soil, or waste so
36+ that the fluid, impacted soil, or waste will not migrate from the
37+ area covered by the landtreatment permit.
5138 (a-1) With each application for a fluid injection well
5239 permit, the applicant shall submit to the commission a
5340 nonrefundable fee of $200.
5441 (b) An applicant [With each application] for a permit to
5542 store, treat, or dispose of certain oil and gas waste [discharge to
5643 surface water under this chapter and commission rules, other than a
5744 permit for a discharge that meets National Pollutant Discharge
5845 Elimination System requirements for agricultural or wildlife use,
5946 the applicant] shall submit to the commission a nonrefundable fee
6047 for that application as follows:
6148 (1) $500 for an application for a landfarm,
6249 landtreatment, or land application permit or permit amendment;
6350 (2) $2,000 for an application for a commercial oil and
6451 gas waste separation facility permit;
6552 (3) $1,000 for an application for an amendment to a
66- commercial oil and gas waste separation facility permit;
53+ commercial waste separation facility permit;
6754 (4) $3,000 for an application for a commercial surface
68- oil and gas waste disposal facility permit; and
55+ oil and gas waste facility permit; and
6956 (5) $1,000 for an application for an amendment to a
70- commercial surface oil and gas waste disposal facility permit [of
71- $300].
57+ commercial surface waste facility permit [of $300].
7258 SECTION 2. Section 91.1013, Natural Resources Code, as
7359 amended by this Act, applies only to an application for the issuance
7460 or amendment of a permit that is filed with the Railroad Commission
7561 of Texas on or after the effective date of this Act. An application
7662 for a permit filed before the effective date of this Act is governed
7763 by the law in effect on the date of the filing, and the former law is
7864 continued in effect for that purpose.
7965 SECTION 3. This Act takes effect September 1, 2025.
