77 AN ACT
88 relating to certain planning, notification, and evaluation
99 requirements with respect to workforce development programs in this
1010 state.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 2308.304, Government Code, is amended by
1313 adding Subsection (c-1) to read as follows:
1414 (c-1) In establishing goals, objectives, and performance
1515 measures for segments of the population under Subsection (c), the
1616 plan must establish specific goals, objectives, and performance
1717 measures for individuals who are at least 16 years of age but
1818 younger than 25 years of age.
1919 SECTION 2. Chapter 2308, Government Code, is amended by
2020 adding Subchapter H to read as follows:

2222 DEVELOPMENT BOARDS AND DIVISION
2323 Sec. 2308.351. NOTICE OF FINANCIAL INCENTIVE. (a) In this
2424 section:
2525 (1) "Commission" means the Texas Workforce
2626 Commission.
2727 (2) "Financial incentive" means a financial benefit,
2828 including a grant, loan, or tax preference, or a combination of
2929 those benefits, offered by a governmental entity to any person.
3030 (3) "Governmental entity" means a state agency or
3131 political subdivision of this state, including a municipality or
3232 county.
3333 (b) A governmental entity that provides a financial
3434 incentive that results in the creation of at least 100 estimated new
3535 employment opportunities shall, not later than the 30th day after
3636 the date the governmental entity approves the financial incentive,
3737 notify the commission and any local workforce development board
3838 operating in a workforce development area where the financial
3939 incentive is distributed of the plan to distribute the financial
4040 incentive.
4141 (c) The notice required by Subsection (b) must include:
4242 (1) the estimated number of new employment
4343 opportunities the financial incentive will create;
4444 (2) the estimated start date for each new employment
4545 opportunity created by the financial incentive; and
4646 (3) a description of the skills and training necessary
4747 for applicants for each new employment opportunity created by the
4848 financial incentive.
4949 SECTION 3. Subchapter E, Chapter 302, Labor Code, is
5050 amended by adding Section 302.087 to read as follows:
5151 Sec. 302.087. EVALUATION OF WORKFORCE DEVELOPMENT
5252 ACTIVITIES. (a) The commission shall annually evaluate:
5353 (1) the effectiveness of the commission's workforce
5454 development program; and
5555 (2) the best practices for allocating workforce
5656 development funds to and by local workforce development boards to:
5757 (A) meet the current and projected workforce
5858 needs of employers in workforce development areas; and
5959 (B) provide workforce development services to
6060 individuals who are at least 16 years of age but younger than 25
6161 years of age.
6262 (b) The evaluation under Subsection (a) must include:
6363 (1) a calculation of the respective percentages of
6464 workforce funds spent annually on efforts to:
6565 (A) increase employment among individuals who
6666 are at least 16 years of age but younger than 25 years of age;
6767 (B) reenroll individuals who have dropped out of
6868 a public or open-enrollment charter school and who are at least 16
6969 years of age but younger than 25 years of age; and
7070 (C) facilitate the participation of individuals
7171 who are at least 16 years of age but less than 25 years of age in
7272 postsecondary education, technical education, or the military;
7373 (2) the respective numbers of individuals who are at
7474 least 16 years of age but younger than 25 years of age who:
7575 (A) have dropped out of a public or
7676 open-enrollment charter school and are assisted in reenrollment
7777 with workforce funds; and
7878 (B) receive assistance in participating in
7979 postsecondary education, technical education, or the military;
8080 (3) for each local workforce development area:
8181 (A) the respective numbers of individuals who are
8282 at least 16 years of age but younger than 25 years of age who:
8383 (i) are eligible for workforce development
8484 services; and
8585 (ii) annually receive workforce
8686 development services, including the number receiving assistance in
8787 enrolling in high school, a high school equivalency program, an
8888 apprenticeship program, an institution of higher education, a
8989 technical school, or the military; and
9090 (B) the total number of workforce development
9191 service providers actively serving individuals who are at least 16
9292 years of age but younger than 25 years of age in the area;
9393 (4) for each local workforce development board, an
9494 assessment of the board's current use of workforce funds to
9595 determine and meet the current and projected workforce needs of
9696 employers in the workforce development area;
9797 (5) examples of efforts to reach individuals who are
9898 at least 16 years of age but less than 25 years of age in which the
9999 commission and local workforce development boards coordinated with
100100 each of the following respective entities:
101101 (A) the Texas Education Agency, school
102102 districts, or open-enrollment charter schools;
103103 (B) the Texas Higher Education Coordinating
104104 Board or institutions of higher education; and
105105 (C) the Department of Family and Protective
106106 Services; and
107107 (6) examples of efforts to meet current and projected
108108 workforce needs in which the commission and local workforce
109109 development boards coordinated with each of the following
110110 respective entities:
111111 (A) private employers or other members of the
112112 business community; and
113113 (B) workforce development service providers.
114114 (c) The commission shall make the evaluation conducted
115115 under Subsection (a), any information collected in the course of
116116 conducting the evaluation, and any findings of the commission
117117 arising from the evaluation readily available to local workforce
118118 development boards, employers, institutions of higher education,
119119 school districts, open-enrollment charter schools, and the public.
120120 (d) Not later than January 15 of each odd-numbered year, the
121121 commission shall make a report to the legislature detailing the
122122 commission's findings on the effectiveness of the commission's
123123 workforce development program. The report must include:
124124 (1) the information described by Subsection (b);
125125 (2) employment outcome information for individuals
126126 who are at least 16 years of age but less than 25 years of age,
127127 disaggregated by local workforce development area;
128128 (3) an analysis of multiyear trends identifiable from
129129 the information contained in the evaluation conducted under
130130 Subsection (a), including any identifiable trends that show
131131 positive impacts of workforce development programs on workforce
132132 participation of individuals who are at least 16 years of age but
133133 less than 25 years of age; and
134134 (4) the commission's recommendation for legislative or
135135 regulatory action, including recommendations for regulatory action
136136 by other governmental entities.
137137 SECTION 4. This Act takes effect September 1, 2025.
