88 AN ACT
99 relating to investigations of certain cybercrimes.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle B, Title 4, Government Code, is amended
1212 by adding Chapter 426 to read as follows:
1313 CHAPTER 426. CYBERCRIMES
1414 Sec. 426.001. DEFINITION. In this chapter, "cybercrime"
1515 means an offense:
1616 (1) under Chapter 31, 32, 33, 33A, 34, 35, 42, 71, 72,
1717 or 76, Penal Code; and
1818 (2) that is committed using an Internet website or an
1919 electronic service account provided through an electronic
2020 communication service or remote computing service.
2121 Sec. 426.002. ADMINISTRATIVE SUBPOENA. (a) A prosecuting
2222 attorney may issue and cause to be served an administrative
2323 subpoena that requires the production of records or other
2424 documentation as described by Subsection (c) if:
2525 (1) the subpoena relates to an investigation of a
2626 cybercrime; and
2727 (2) there is reasonable cause to believe that the
2828 Internet or electronic service account provided through an
2929 electronic communication service or remote computing service has
3030 been used in the commission of a cybercrime.
3131 (b) A subpoena under Subsection (a) must:
3232 (1) describe any objects or items to be produced; and
3333 (2) prescribe a reasonable return date by which those
3434 objects or items must be assembled and made available.
3535 (c) Except as provided by Subsection (d), a subpoena issued
3636 under Subsection (a) may require the production of any records or
3737 other documentation relevant to the investigation, including:
3838 (1) a name;
3939 (2) an address;
4040 (3) a local or long distance telephone connection
4141 record, satellite-based Internet service provider connection
4242 record, or record of session time and duration;
4343 (4) the duration of the applicable service, including
4444 the start date for the service and the type of service used;
4545 (5) a telephone or instrument number or other number
4646 used to identify a subscriber, including a temporarily assigned
4747 network address; and
4848 (6) the source of payment for the service, including a
4949 credit card or bank account number.
5050 (d) A provider of an electronic communication service or
5151 remote computing service may not disclose the following information
5252 in response to a subpoena issued under Subsection (a):
5353 (1) an in-transit electronic communication;
5454 (2) an account membership related to an Internet
5555 group, newsgroup, mailing list, or specific area of interest;
5656 (3) an account password; or
5757 (4) any account content, including:
5858 (A) any form of electronic mail;
5959 (B) an address book, contact list, or buddy list;
6060 or
6161 (C) Internet proxy content or Internet history.
6262 (e) A provider of an electronic communication service or
6363 remote computing service shall disclose the information described
6464 by Subsection (d) if that disclosure is required by court order.
6565 (f) A person authorized to serve process under the Texas
6666 Rules of Civil Procedure may serve a subpoena issued under
6767 Subsection (a). The person shall serve the subpoena in accordance
6868 with the Texas Rules of Civil Procedure.
6969 (g) Before the return date specified on a subpoena issued
7070 under Subsection (a), the person receiving the subpoena may, in an
7171 appropriate court located in the county where the subpoena was
7272 issued, petition for an order to modify or quash the subpoena or to
7373 prohibit disclosure of applicable information by a court.
7474 (h) If a criminal case or proceeding does not result from
7575 the production of records or other documentation under this section
7676 within a reasonable period, the prosecuting attorney shall, as
7777 appropriate:
7878 (1) destroy the records or documentation; or
7979 (2) return the records or documentation to the person
8080 who produced the records or documentation.
8181 Sec. 426.003. CONFIDENTIALITY OF INFORMATION. Any
8282 information, records, or data reported or obtained under a subpoena
8383 issued under Section 426.002(a):
8484 (1) is confidential; and
8585 (2) may not be disclosed to any other person unless the
8686 disclosure is made as part of a criminal case related to those
8787 materials.
8888 SECTION 2. This Act takes effect September 1, 2025.
