77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to increasing the criminal penalty for certain conduct
1010 constituting the offense of trafficking of persons.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 20A.02(b-1), Penal Code, as amended by
1313 Chapters 451 (H.B. 3553) and 452 (H.B. 3554), Acts of the 88th
1414 Legislature, Regular Session, 2023, is reenacted and amended to
1515 read as follows:
1616 (b-1) An offense under this section is a felony of the first
1717 degree punishable by imprisonment in the Texas Department of
1818 Criminal Justice for life or for a term of not more than 99 years or
1919 less than 25 years if it is shown on the trial of the offense that
2020 the actor committed any part of the offense [in a location that
2121 was]:
2222 (1) on the premises of or within 1,000 feet of the
2323 premises of:
2424 (A) a school or a school bus stop or other area
2525 designated by a school as a pick-up or drop-off zone for students;
2626 [or]
2727 (B) an institution of higher education or private
2828 or independent institution of higher education, as defined by
2929 Section 61.003, Education Code;
3030 (C) [(B)] a juvenile detention facility;
3131 (D) [(C)] a post-adjudication secure
3232 correctional facility;
3333 (E) [(D)] a shelter or facility operating as a
3434 residential treatment center that serves runaway youth, foster
3535 children, people who are homeless, or persons subjected to human
3636 trafficking, domestic violence, or sexual assault;
3737 (F) [(E)] a community center offering youth
3838 services and programs; or
3939 (G) [(F)] a child-care facility, as defined by
4040 Section 42.002, Human Resources Code; [or]
4141 (2) on the premises where or within 1,000 feet of the
4242 premises where:
4343 (A) an official school function was taking place;
4444 or
4545 (B) an event sponsored or sanctioned by the
4646 University Interscholastic League was taking place; or
4747 (3) in a school bus or other passenger transportation
4848 vehicle of a school.
4949 SECTION 2. The change in law made by this Act applies only
5050 to an offense committed on or after the effective date of this Act.
5151 An offense committed before the effective date of this Act is
5252 governed by the law in effect on the date the offense was committed,
5353 and the former law is continued in effect for that purpose. For
5454 purposes of this section, an offense was committed before the
5555 effective date of this Act if any element of the offense occurred
5656 before that date.
5757 SECTION 3. This Act takes effect September 1, 2025.
