9 | 9 | | relating to increasing the criminal penalty for certain conduct |

10 | 10 | | constituting the offense of trafficking of persons. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 20A.02(b-1), Penal Code, as amended by |
---|
13 | 13 | | Chapters 451 (H.B. 3553) and 452 (H.B. 3554), Acts of the 88th |
---|
14 | 14 | | Legislature, Regular Session, 2023, is reenacted and amended to |
---|
15 | 15 | | read as follows: |
---|
16 | 16 | | (b-1) An offense under this section is a felony of the first |
---|
17 | 17 | | degree punishable by imprisonment in the Texas Department of |
---|
18 | 18 | | Criminal Justice for life or for a term of not more than 99 years or |
---|
19 | 19 | | less than 25 years if it is shown on the trial of the offense that |
---|
20 | 20 | | the actor committed any part of the offense [in a location that |
---|
21 | 21 | | was]: |
---|
22 | 22 | | (1) on the premises of or within 1,000 feet of the |
---|
23 | 23 | | premises of: |
---|
24 | 24 | | (A) a school or a school bus stop or other area |
---|
25 | 25 | | designated by a school as a pick-up or drop-off zone for students; |
---|
26 | 26 | | [or] |
---|
27 | 27 | | (B) an institution of higher education or private |
---|
28 | 28 | | or independent institution of higher education, as defined by |
---|
29 | 29 | | Section 61.003, Education Code; |
---|
30 | 30 | | (C) [(B)] a juvenile detention facility; |
---|
31 | 31 | | (D) [(C)] a post-adjudication secure |
---|
32 | 32 | | correctional facility; |
---|
33 | 33 | | (E) [(D)] a shelter or facility operating as a |
---|
34 | 34 | | residential treatment center that serves runaway youth, foster |
---|
35 | 35 | | children, people who are homeless, or persons subjected to human |
---|
36 | 36 | | trafficking, domestic violence, or sexual assault; |
---|
37 | 37 | | (F) [(E)] a community center offering youth |
---|
38 | 38 | | services and programs; or |
---|
39 | 39 | | (G) [(F)] a child-care facility, as defined by |
---|
40 | 40 | | Section 42.002, Human Resources Code; [or] |
---|
41 | 41 | | (2) on the premises where or within 1,000 feet of the |
---|
42 | 42 | | premises where: |
---|
43 | 43 | | (A) an official school function was taking place; |
---|
44 | 44 | | or |
---|
45 | 45 | | (B) an event sponsored or sanctioned by the |
---|
46 | 46 | | University Interscholastic League was taking place; or |
---|
47 | 47 | | (3) in a school bus or other passenger transportation |
---|
48 | 48 | | vehicle of a school. |
---|
49 | 49 | | SECTION 2. The change in law made by this Act applies only |
---|
50 | 50 | | to an offense committed on or after the effective date of this Act. |
---|
51 | 51 | | An offense committed before the effective date of this Act is |
---|
52 | 52 | | governed by the law in effect on the date the offense was committed, |
---|
53 | 53 | | and the former law is continued in effect for that purpose. For |
---|
54 | 54 | | purposes of this section, an offense was committed before the |
---|
55 | 55 | | effective date of this Act if any element of the offense occurred |
---|
56 | 56 | | before that date. |
---|
57 | 57 | | SECTION 3. This Act takes effect September 1, 2025. |
