77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of certain municipalities to receive
1010 certain tax revenue derived from a hotel and convention center
1111 project and to pledge certain tax revenue for the payment of
1212 obligations related to the project.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 351.152, Tax Code, is amended to read as
1515 follows:
1616 Sec. 351.152. APPLICABILITY. This subchapter applies only
1717 to:
1818 (1) a municipality described by Section
1919 351.001(7)(B);
2020 (2) a municipality described by Section
2121 351.001(7)(D);
2222 (3) a municipality described by Section
2323 351.001(7)(E);
2424 (3-a) a municipality described by Section
2525 351.001(11);
2626 (4) a municipality described by Section
2727 351.102(e)(3);
2828 (5) a municipality that contains more than 70 percent
2929 of the population of a county with a population of 1.5 million or
3030 more;
3131 (6) a municipality with a population of 175,000 or
3232 more but less than 200,000 that is partially located in at least one
3333 county with a population of 125,000 or more;
3434 (7) a municipality with a population of 250,000 or
3535 more but less than one million that is located in one county with a
3636 population of 2.5 million or more;
3737 (8) a municipality with a population of 180,000 or
3838 more that:
3939 (A) is located in two counties, each with a
4040 population of 100,000 or more; and
4141 (B) contains an American Quarter Horse Hall of
4242 Fame and Museum;
4343 (9) a municipality with a population of 96,000 or more
4444 that is located in a county that borders Lake Palestine;
4545 (10) a municipality with a population of 96,000 or
4646 more that is located in a county that contains the headwaters of the
4747 San Gabriel River;
4848 (11) a municipality with a population of at least
4949 95,000 that is located in a county that is bisected by United States
5050 Highway 385 and has a population of not more than 170,000;
5151 (12) a municipality with a population of 110,000 or
5252 more but less than 135,000 at least part of which is located in a
5353 county with a population of less than 135,000;
5454 (13) a municipality with a population of 28,000 or
5555 more but less than 31,000 that is located in two counties, each of
5656 which has a population of 900,000 or more and a southern border with
5757 a county with a population of 2.5 million or more;
5858 (14) a municipality with a population of 200,000 or
5959 more but less than 300,000 that contains a component institution of
6060 the Texas Tech University System;
6161 (15) a municipality with a population of 95,000 or
6262 more that:
6363 (A) is located in more than one county; and
6464 (B) borders Lake Lewisville;
6565 (16) a municipality with a population of 45,000 or
6666 more that:
6767 (A) contains a portion of Cedar Hill State Park;
6868 (B) is located in two counties, one of which has a
6969 population of 2.5 million or more and one of which has a population
7070 of 190,000 or more; and
7171 (C) has adopted a capital improvement plan for
7272 the construction or expansion of a convention center facility;
7373 (17) a municipality with a population of less than
7474 10,000 that:
7575 (A) is almost wholly located in a county with a
7676 population of 900,000 or more that is adjacent to a county with a
7777 population of 2.5 million or more;
7878 (B) is partially located in a county with a
7979 population of 2.1 million or more that is adjacent to a county with
8080 a population of 2.5 million or more;
8181 (C) has a visitor center and museum located in a
8282 19th-century rock building in the municipality's downtown; and
8383 (D) has a waterpark open to the public;
8484 (18) a municipality with a population of 60,000 or
8585 more that:
8686 (A) borders Lake Ray Hubbard; and
8787 (B) is located in two counties, one of which has a
8888 population of less than 110,000;
8989 (19) a municipality with a population of 110,000 or
9090 more that:
9191 (A) borders Clear Lake; and
9292 (B) is primarily located in a county with a
9393 population of less than 355,000;
9494 (20) a municipality with a population of less than
9595 2,000 that:
9696 (A) is located adjacent to a bay connected to the
9797 Gulf of Mexico;
9898 (B) is located in a county with a population of
9999 290,000 or more that is adjacent to a county with a population of
100100 four million or more; and
101101 (C) has a boardwalk on the bay;
102102 (21) a municipality with a population of 75,000 or
103103 more that:
104104 (A) is located wholly in one county with a
105105 population of 800,000 or more that is adjacent to a county with a
106106 population of four million or more; and
107107 (B) has adopted a capital improvement plan for
108108 the construction or expansion of a convention center facility;
109109 (22) a municipality with a population of less than
110110 70,000 that is located in three counties, at least one of which has
111111 a population of four million or more;
112112 (23) an eligible coastal municipality with a
113113 population of 2,900 or more but less than 5,000;
114114 (24) a municipality with a population of 90,000 or
115115 more but less than 150,000 that:
116116 (A) is located in three counties; and
117117 (B) contains a branch campus of a component
118118 institution of the University of Houston System;
119119 (25) a municipality that is:
120120 (A) primarily located in a county with a
121121 population of four million or more; and
122122 (B) connected by a bridge to a municipality
123123 described by Subdivision (20);
124124 (26) a municipality with a population of 25,000 or
125125 more but less than 30,000 that:
126126 (A) contains a portion of Mustang Bayou; and
127127 (B) is wholly located in a county with a
128128 population of less than 500,000;
129129 (27) a municipality with a population of 70,000 or
130130 more but less than 90,000 that is located in two counties, one of
131131 which has a population of four million or more and the other of
132132 which has a population of less than 50,000;
133133 (28) a municipality with a population of 10,000 or
134134 more that:
135135 (A) is wholly located in a county with a
136136 population of four million or more; and
137137 (B) has a city hall located less than three miles
138138 from a space center operated by an agency of the federal government;
139139 (29) a municipality that is the county seat of a
140140 county:
141141 (A) through which the Pedernales River flows; and
142142 (B) in which the birthplace of a president of the
143143 United States is located;
144144 (30) a municipality that contains a portion of U.S.
145145 Highway 79 and State Highway 130;
146146 (31) a municipality with a population of 70,000 or
147147 more but less than 115,000 that is located in two counties, one of
148148 which has a population of 1.1 million or more but less than 1.9
149149 million;
150150 (32) a municipality with a population of less than
151151 25,000 that contains a museum of Western American art;
152152 (33) a municipality with a population of 50,000 or
153153 more that is the county seat of a county that contains a portion of
154154 the Sam Houston National Forest;
155155 (34) a municipality with a population of less than
156156 25,000 that:
157157 (A) contains a cultural heritage museum; and
158158 (B) is located in a county that borders the
159159 United Mexican States and the Gulf of Mexico;
160160 (35) a municipality that is the county seat of a county
161161 that:
162162 (A) has a population of 115,000 or more;
163163 (B) is adjacent to a county with a population of
164164 2.1 million or more; and
165165 (C) hosts an annual peach festival;
166166 (36) a municipality that is the county seat of a county
167167 that:
168168 (A) has a population of 800,000 or more; and
169169 (B) is adjacent to a county with a population of
170170 four million or more;
171171 (37) a municipality with a population of less than
172172 10,000 that:
173173 (A) contains a component university of The Texas
174174 A&M University System; and
175175 (B) is located in a county adjacent to a county
176176 that borders Oklahoma;
177177 (38) a municipality with a population of less than
178178 17,000 that:
179179 (A) is located in two counties, each of which has
180180 a population of 900,000 or more but less than two million; and
181181 (B) hosts an annual Cajun Festival;
182182 (39) a municipality with a population of 13,000 or
183183 more that:
184184 (A) is located on an international border; and
185185 (B) is located in a county:
186186 (i) with a population of less than 400,000;
187187 and
188188 (ii) in which at least one World Birding
189189 Center site is located;
190190 (40) a municipality with a population of 3,200 or more
191191 that:
192192 (A) is located on an international border; and
193193 (B) is located not more than five miles from a
194194 state historic site that serves as a visitor center for a state park
195195 that contains 300,000 or more acres of land;
196196 (41) a municipality with a population of 36,000 or
197197 more that is adjacent to at least two municipalities described by
198198 Subdivision (15);
199199 (42) a municipality with a population of 28,000 or
200200 more that is located in a county with a population of 240,000 or
201201 more that contains a portion of the Blanco River and in which is
202202 located a historic railroad depot and heritage center;
203203 (43) a municipality located in a county that has a
204204 population of not more than 300,000 and in which a component
205205 university of the University of Houston System is located;
206206 (44) a municipality with a population of less than
207207 500,000 that is:
208208 (A) located in two counties; and
209209 (B) adjacent to a municipality described by
210210 Subdivision (31);
211211 (45) a municipality that:
212212 (A) has a population of more than 67,000; and
213213 (B) is located in two counties with 90 percent of
214214 the municipality's territory located in a county with a population
215215 of at least 800,000, and the remaining territory located in a county
216216 with a population of at least four million;
217217 (46) a municipality that:
218218 (A) has a population of 100,000 or more; and
219219 (B) is wholly located in, but is not the county
220220 seat of, a county with a population of one million or more:
221221 (i) in which all or part of a municipality
222222 with a population of one million or more is located; and
223223 (ii) that is adjacent to a county with a
224224 population of 2.5 million or more;
225225 (47) a municipality that is the county seat of a county
226226 bordering the Gulf of Mexico and the United Mexican States;
227227 (48) a municipality that is bisected by the Guadalupe
228228 River and is the county seat of a county with a population of
229229 170,000 or more;
230230 (49) a municipality with a population of 70,000 or
231231 more but less than 150,000 that borders Joe Pool Lake;
232232 (50) a municipality with a population of 115,000 or
233233 more that borders the Neches River;
234234 (51) a municipality described by Section 351.101(k);
235235 (52) a municipality that is the county seat of a
236236 county:
237237 (A) through which the Brazos River flows; and
238238 (B) in which a national monument is located;
239239 (53) a municipality with a population of 45,000 or
240240 more that:
241241 (A) is not the county seat of a county;
242242 (B) is located in a single county; and
243243 (C) contains a portion of Lake Lewisville;
244244 (54) a municipality that is the county seat of a county
245245 with a population of more than 900,000 that is adjacent to two
246246 counties, each of which has a population of more than 1.8 million;
247247 (55) a municipality that hosts an annual wine festival
248248 and is located in three counties, each of which has a population of
249249 more than 900,000;
250250 (56) a municipality that has a population of at least
251251 150,000 but less than 1,300,000 and is partially located in a county
252252 that contains a portion of Cedar Creek Reservoir;
253253 (57) a municipality that is located in a county that
254254 contains a portion of Cedar Creek Reservoir and in which a private
255255 college is located;
256256 (58) a municipality that is the county seat of a
257257 county:
258258 (A) with a population of one million or more;
259259 (B) in which all or part of a municipality with a
260260 population of one million or more is located; and
261261 (C) that is located adjacent to a county with a
262262 population of 2.5 million or more;
263263 (59) a municipality that is the county seat of a county
264264 that contains a portion of Cedar Creek Reservoir and borders a
265265 county with a population of more than 240,000;
266266 (60) a municipality with a population of more than
267267 80,000 but less than 150,000 that is located in a county with a
268268 population of more than 369,000 but less than 864,000 that contains
269269 part of an active duty United States Army installation;
270270 (61) a municipality with a population of 750,000 or
271271 more that is located in a county with a population of 1.5 million or
272272 less;
273273 (62) a municipality with a population of less than
274274 7,000 that contains a country music hall of fame;
275275 (63) a municipality with a population of 35,000 or
276276 more that contains a railroad museum and is located in a county
277277 that:
278278 (A) has a population of 800,000 or more; and
279279 (B) is adjacent to a county with a population of
280280 four million or more; and
281281 (64) a municipality:
282282 (A) that is the county seat of a county:
283283 (i) with a population of 60,000 or less; and
284284 (ii) that borders the Rio Grande; and
285285 (B) in which is located a United States military
286286 fort listed in the National Register of Historic Places.
287287 SECTION 2. This Act takes effect immediately if it receives
288288 a vote of two-thirds of all the members elected to each house, as
289289 provided by Section 39, Article III, Texas Constitution. If this
290290 Act does not receive the vote necessary for immediate effect, this
291291 Act takes effect September 1, 2025.
