| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter B, Chapter 118, Local Government |
|---|
| 13 | 13 | | Code, is amended by adding Section 118.027 to read as follows: |
|---|
| 14 | 14 | | Sec. 118.027. FEE FOR HOUSING FIRST INITIATIVES IN CERTAIN |
|---|
| 15 | 15 | | COUNTIES. (a) This section applies only to a county with a |
|---|
| 16 | 16 | | population of 500,000 or more. |
|---|
| 17 | 17 | | (b) The commissioners court of a county may adopt a housing |
|---|
| 18 | 18 | | first initiatives fee. The fee must be: |
|---|
| 19 | 19 | | (1) adopted by the commissioners court at an open |
|---|
| 20 | 20 | | meeting; and |
|---|
| 21 | 21 | | (2) itemized in the county's annual budget as part of |
|---|
| 22 | 22 | | the budget preparation process. |
|---|
| 23 | 23 | | (c) The fee shall be paid by a person at the time the person |
|---|
| 24 | 24 | | pays a fee under Section 118.011(a)(1) or (2). |
|---|
| 25 | 25 | | (d) The fee shall be deposited in a separate housing first |
|---|
| 26 | 26 | | initiatives account in the general fund of the county. Any interest |
|---|
| 27 | 27 | | that accrues on the account remains with the account. |
|---|
| 28 | 28 | | (e) Revenue collected from the fee may be used only to fund |
|---|
| 29 | 29 | | housing initiatives, including: |
|---|
| 30 | 30 | | (1) emergency shelter expansion; |
|---|
| 31 | 31 | | (2) homelessness prevention services; |
|---|
| 32 | 32 | | (3) street outreach programs; |
|---|
| 33 | 33 | | (4) rapid rehousing programs; and |
|---|
| 34 | 34 | | (5) transitional housing programs. |
|---|
| 35 | 35 | | (f) The county may contract with a private entity, a |
|---|
| 36 | 36 | | nonprofit corporation, or a political subdivision to undertake an |
|---|
| 37 | 37 | | initiative authorized by this section. |
|---|
| 38 | 38 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 39 | 39 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 40 | 40 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 41 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 42 | | Act takes effect September 1, 2025. |
