77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to qualifications and registration of certain voters on
1010 parole or mandatory supervision.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 11.002(a), Election Code, is amended to
1313 read as follows:
1414 (a) In this code, "qualified voter" means a person who:
1515 (1) is 18 years of age or older;
1616 (2) is a United States citizen;
1717 (3) has not been determined by a final judgment of a
1818 court exercising probate jurisdiction to be:
1919 (A) totally mentally incapacitated; or
2020 (B) partially mentally incapacitated without the
2121 right to vote;
2222 (4) has not been finally convicted of a felony or, if
2323 so convicted, has:
2424 (A) completed [fully discharged the person's
2525 sentence, including] any term of incarceration[, parole,] or
2626 community supervision, or completed a period of probation ordered
2727 by any court;
2828 (B) been released on parole or mandatory
2929 supervision; or
3030 (C) [(B)] been pardoned or otherwise released
3131 from the resulting disability to vote;
3232 (5) is a resident of this state; and
3333 (6) is a registered voter.
3434 SECTION 2. Section 13.001(a), Election Code, is amended to
3535 read as follows:
3636 (a) To be eligible for registration as a voter in this
3737 state, a person must:
3838 (1) be 18 years of age or older;
3939 (2) be a United States citizen;
4040 (3) not have been determined by a final judgment of a
4141 court exercising probate jurisdiction to be:
4242 (A) totally mentally incapacitated; or
4343 (B) partially mentally incapacitated without the
4444 right to vote;
4545 (4) not have been finally convicted of a felony or, if
4646 so convicted, must have:
4747 (A) completed [fully discharged the person's
4848 sentence, including] any term of incarceration[, parole,] or
4949 community supervision, or completed a period of probation ordered
5050 by any court;
5151 (B) been released on parole or mandatory
5252 supervision; or
5353 (C) [(B)] been pardoned or otherwise released
5454 from the resulting disability to vote; and
5555 (5) be a resident of the county in which application
5656 for registration is made.
5757 SECTION 3. This Act takes effect immediately if it receives
5858 a vote of two-thirds of all the members elected to each house, as
5959 provided by Section 39, Article III, Texas Constitution. If this
6060 Act does not receive the vote necessary for immediate effect, this
6161 Act takes effect September 1, 2025.
