77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a statewide order issued by the commissioner of state
1010 health services authorizing a pharmacist to dispense ivermectin.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter D, Chapter 1001, Health and Safety
1313 Code, is amended by adding Section 1001.090 to read as follows:
1414 Sec. 1001.090. STATEWIDE ORDER AUTHORIZING DISPENSING OF
1515 IVERMECTIN. (a) The commissioner shall issue a statewide order
1616 authorizing a licensed pharmacist to dispense ivermectin without a
1717 health care practitioner's prescription order notwithstanding any
1818 other law.
1919 (b) The statewide order must include written, standardized
2020 procedures or protocols for a pharmacist to follow when dispensing
2121 ivermectin and require the pharmacist to provide each patient with
2222 instructions on the proper use of ivermectin.
2323 (c) Notwithstanding any other law, a pharmacist may
2424 dispense ivermectin in accordance with the statewide order.
2525 (d) Except for wilful misconduct or gross negligence and
2626 notwithstanding any other law, a pharmacist acting in good faith is
2727 not criminally or civilly liable or subject to professional
2828 disciplinary action for dispensing ivermectin in accordance with
2929 the statewide order.
3030 (e) A pharmacist dispensing ivermectin in accordance with
3131 the statewide order shall provide an annual written report in the
3232 form and manner the department prescribes on the number of doses of
3333 ivermectin the pharmacist dispensed in accordance with the
3434 statewide order in the preceding calendar year.
3535 (f) The executive commissioner and the Texas State Board of
3636 Pharmacy may adopt the rules necessary to implement this section.
3737 SECTION 2. As soon as practicable after the effective date
3838 of this Act, the commissioner of state health services shall issue a
3939 statewide order in accordance with Section 1001.090, Health and
4040 Safety Code, as added by this Act.
4141 SECTION 3. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2025.
