| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter D, Chapter 1001, Health and Safety |
|---|
| 13 | 13 | | Code, is amended by adding Section 1001.090 to read as follows: |
|---|
| 14 | 14 | | Sec. 1001.090. STATEWIDE ORDER AUTHORIZING DISPENSING OF |
|---|
| 15 | 15 | | IVERMECTIN. (a) The commissioner shall issue a statewide order |
|---|
| 16 | 16 | | authorizing a licensed pharmacist to dispense ivermectin without a |
|---|
| 17 | 17 | | health care practitioner's prescription order notwithstanding any |
|---|
| 18 | 18 | | other law. |
|---|
| 19 | 19 | | (b) The statewide order must include written, standardized |
|---|
| 20 | 20 | | procedures or protocols for a pharmacist to follow when dispensing |
|---|
| 21 | 21 | | ivermectin and require the pharmacist to provide each patient with |
|---|
| 22 | 22 | | instructions on the proper use of ivermectin. |
|---|
| 23 | 23 | | (c) Notwithstanding any other law, a pharmacist may |
|---|
| 24 | 24 | | dispense ivermectin in accordance with the statewide order. |
|---|
| 25 | 25 | | (d) Except for wilful misconduct or gross negligence and |
|---|
| 26 | 26 | | notwithstanding any other law, a pharmacist acting in good faith is |
|---|
| 27 | 27 | | not criminally or civilly liable or subject to professional |
|---|
| 28 | 28 | | disciplinary action for dispensing ivermectin in accordance with |
|---|
| 29 | 29 | | the statewide order. |
|---|
| 30 | 30 | | (e) A pharmacist dispensing ivermectin in accordance with |
|---|
| 31 | 31 | | the statewide order shall provide an annual written report in the |
|---|
| 32 | 32 | | form and manner the department prescribes on the number of doses of |
|---|
| 33 | 33 | | ivermectin the pharmacist dispensed in accordance with the |
|---|
| 34 | 34 | | statewide order in the preceding calendar year. |
|---|
| 35 | 35 | | (f) The executive commissioner and the Texas State Board of |
|---|
| 36 | 36 | | Pharmacy may adopt the rules necessary to implement this section. |
|---|
| 37 | 37 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 38 | 38 | | of this Act, the commissioner of state health services shall issue a |
|---|
| 39 | 39 | | statewide order in accordance with Section 1001.090, Health and |
|---|
| 40 | 40 | | Safety Code, as added by this Act. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2025. |
