66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the operation of a motor vehicle in a school crossing
99 zone while intoxicated; increasing a criminal penalty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 49.04, Penal Code, is amended by
1212 amending Subsection (b) and adding Subsection (e) to read as
1313 follows:
1414 (b) Except as provided by Subsections (c), [and] (d), and
1515 (e) and Section 49.09, an offense under this section is a Class B
1616 misdemeanor, with a minimum term of confinement of 72 hours.
1717 (e) If it is shown on the trial of an offense under this
1818 section that at the time of the offense the person was operating the
1919 motor vehicle in a school crossing zone during the time the reduced
2020 speed limit applies to the zone, the offense is a state jail felony.
2121 In this subsection, "school crossing zone" has the meaning assigned
2222 by Section 541.302, Transportation Code.
2323 SECTION 2. The change in law made by this Act applies only
2424 to an offense committed on or after the effective date of this Act.
2525 An offense committed before the effective date of this Act is
2626 governed by the law in effect on the date the offense was committed,
2727 and the former law is continued in effect for that purpose. For
2828 purposes of this section, an offense was committed before the
2929 effective date of this Act if any element of the offense occurred
3030 before that date.
3131 SECTION 3. This Act takes effect September 1, 2025.
