77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of certain municipalities to receive
1010 certain tax revenue derived from a hotel and convention center
1111 project and to pledge certain tax revenue for the payment of
1212 obligations related to the project.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 351.152, Tax Code, is amended to read as
1515 follows:
1616 Sec. 351.152. APPLICABILITY. This subchapter applies only
1717 to:
1818 (1) a municipality described by Section
1919 351.001(7)(B);
2020 (2) a municipality described by Section
2121 351.001(7)(D);
2222 (3) a municipality described by Section
2323 351.001(7)(E);
2424 (4) a municipality described by Section
2525 351.102(e)(3);
2626 (5) a municipality that contains more than 70 percent
2727 of the population of a county with a population of 1.5 million or
2828 more;
2929 (6) a municipality with a population of 175,000 or
3030 more but less than 200,000 that is partially located in at least one
3131 county with a population of 125,000 or more;
3232 (7) a municipality with a population of 250,000 or
3333 more but less than one million that is located in one county with a
3434 population of 2.5 million or more;
3535 (8) a municipality with a population of 180,000 or
3636 more that:
3737 (A) is located in two counties, each with a
3838 population of 100,000 or more; and
3939 (B) contains an American Quarter Horse Hall of
4040 Fame and Museum;
4141 (9) a municipality with a population of 96,000 or more
4242 that is located in a county that borders Lake Palestine;
4343 (10) a municipality with a population of 96,000 or
4444 more that is located in a county that contains the headwaters of the
4545 San Gabriel River;
4646 (11) a municipality with a population of at least
4747 95,000 that is located in a county that is bisected by United States
4848 Highway 385 and has a population of not more than 170,000;
4949 (12) a municipality with a population of 110,000 or
5050 more but less than 135,000 at least part of which is located in a
5151 county with a population of less than 135,000;
5252 (13) a municipality with a population of 28,000 or
5353 more but less than 31,000 that is located in two counties, each of
5454 which has a population of 900,000 or more and a southern border with
5555 a county with a population of 2.5 million or more;
5656 (14) a municipality with a population of 200,000 or
5757 more but less than 300,000 that contains a component institution of
5858 the Texas Tech University System;
5959 (15) a municipality with a population of 95,000 or
6060 more that:
6161 (A) is located in more than one county; and
6262 (B) borders Lake Lewisville;
6363 (16) a municipality with a population of 45,000 or
6464 more that:
6565 (A) contains a portion of Cedar Hill State Park;
6666 (B) is located in two counties, one of which has a
6767 population of 2.5 million or more and one of which has a population
6868 of 190,000 or more; and
6969 (C) has adopted a capital improvement plan for
7070 the construction or expansion of a convention center facility;
7171 (17) a municipality with a population of less than
7272 10,000 that:
7373 (A) is almost wholly located in a county with a
7474 population of 900,000 or more that is adjacent to a county with a
7575 population of 2.5 million or more;
7676 (B) is partially located in a county with a
7777 population of 2.1 million or more that is adjacent to a county with
7878 a population of 2.5 million or more;
7979 (C) has a visitor center and museum located in a
8080 19th-century rock building in the municipality's downtown; and
8181 (D) has a waterpark open to the public;
8282 (18) a municipality with a population of 60,000 or
8383 more that:
8484 (A) borders Lake Ray Hubbard; and
8585 (B) is located in two counties, one of which has a
8686 population of less than 110,000;
8787 (19) a municipality with a population of 110,000 or
8888 more that:
8989 (A) borders Clear Lake; and
9090 (B) is primarily located in a county with a
9191 population of less than 355,000;
9292 (20) a municipality with a population of less than
9393 2,000 that:
9494 (A) is located adjacent to a bay connected to the
9595 Gulf of Mexico;
9696 (B) is located in a county with a population of
9797 290,000 or more that is adjacent to a county with a population of
9898 four million or more; and
9999 (C) has a boardwalk on the bay;
100100 (21) a municipality with a population of 75,000 or
101101 more that:
102102 (A) is located wholly in one county with a
103103 population of 800,000 or more that is adjacent to a county with a
104104 population of four million or more; and
105105 (B) has adopted a capital improvement plan for
106106 the construction or expansion of a convention center facility;
107107 (22) a municipality with a population of less than
108108 70,000 that is located in three counties, at least one of which has
109109 a population of four million or more;
110110 (23) an eligible coastal municipality with a
111111 population of 2,900 or more but less than 5,000;
112112 (24) a municipality with a population of 90,000 or
113113 more but less than 150,000 that:
114114 (A) is located in three counties; and
115115 (B) contains a branch campus of a component
116116 institution of the University of Houston System;
117117 (25) a municipality that is:
118118 (A) primarily located in a county with a
119119 population of four million or more; and
120120 (B) connected by a bridge to a municipality
121121 described by Subdivision (20);
122122 (26) a municipality with a population of 25,000 or
123123 more but less than 30,000 that:
124124 (A) contains a portion of Mustang Bayou; and
125125 (B) is wholly located in a county with a
126126 population of less than 500,000;
127127 (27) a municipality with a population of 70,000 or
128128 more but less than 90,000 that is located in two counties, one of
129129 which has a population of four million or more and the other of
130130 which has a population of less than 50,000;
131131 (28) a municipality with a population of 10,000 or
132132 more that:
133133 (A) is wholly located in a county with a
134134 population of four million or more; and
135135 (B) has a city hall located less than three miles
136136 from a space center operated by an agency of the federal government;
137137 (29) a municipality that is the county seat of a
138138 county:
139139 (A) through which the Pedernales River flows; and
140140 (B) in which the birthplace of a president of the
141141 United States is located;
142142 (30) a municipality that contains a portion of U.S.
143143 Highway 79 and State Highway 130;
144144 (31) a municipality with a population of 70,000 or
145145 more but less than 115,000 that is located in two counties, one of
146146 which has a population of 1.1 million or more but less than 1.9
147147 million;
148148 (32) a municipality with a population of less than
149149 25,000 that contains a museum of Western American art;
150150 (33) a municipality with a population of 50,000 or
151151 more that is the county seat of a county that contains a portion of
152152 the Sam Houston National Forest;
153153 (34) a municipality with a population of less than
154154 25,000 that:
155155 (A) contains a cultural heritage museum; and
156156 (B) is located in a county that borders the
157157 United Mexican States and the Gulf of Mexico;
158158 (35) a municipality that is the county seat of a county
159159 that:
160160 (A) has a population of 115,000 or more;
161161 (B) is adjacent to a county with a population of
162162 2.1 million or more; and
163163 (C) hosts an annual peach festival;
164164 (36) a municipality that is the county seat of a county
165165 that:
166166 (A) has a population of 800,000 or more; and
167167 (B) is adjacent to a county with a population of
168168 four million or more;
169169 (37) a municipality with a population of less than
170170 10,000 that:
171171 (A) contains a component university of The Texas
172172 A&M University System; and
173173 (B) is located in a county adjacent to a county
174174 that borders Oklahoma;
175175 (38) a municipality with a population of less than
176176 17,000 that:
177177 (A) is located in two counties, each of which has
178178 a population of 900,000 or more but less than two million; and
179179 (B) hosts an annual Cajun Festival;
180180 (39) a municipality with a population of 13,000 or
181181 more that:
182182 (A) is located on an international border; and
183183 (B) is located in a county:
184184 (i) with a population of less than 400,000;
185185 and
186186 (ii) in which at least one World Birding
187187 Center site is located;
188188 (40) a municipality with a population of 3,200 or more
189189 that:
190190 (A) is located on an international border; and
191191 (B) is located not more than five miles from a
192192 state historic site that serves as a visitor center for a state park
193193 that contains 300,000 or more acres of land;
194194 (41) a municipality with a population of 36,000 or
195195 more that is adjacent to at least two municipalities described by
196196 Subdivision (15);
197197 (42) a municipality with a population of 28,000 or
198198 more that is located in a county with a population of 240,000 or
199199 more that contains a portion of the Blanco River and in which is
200200 located a historic railroad depot and heritage center;
201201 (43) a municipality located in a county that has a
202202 population of not more than 300,000 and in which a component
203203 university of the University of Houston System is located;
204204 (44) a municipality with a population of less than
205205 500,000 that is:
206206 (A) located in two counties; and
207207 (B) adjacent to a municipality described by
208208 Subdivision (31);
209209 (45) a municipality that:
210210 (A) has a population of more than 67,000; and
211211 (B) is located in two counties with 90 percent of
212212 the municipality's territory located in a county with a population
213213 of at least 800,000, and the remaining territory located in a county
214214 with a population of at least four million;
215215 (46) a municipality that:
216216 (A) has a population of 100,000 or more; and
217217 (B) is wholly located in, but is not the county
218218 seat of, a county with a population of one million or more:
219219 (i) in which all or part of a municipality
220220 with a population of one million or more is located; and
221221 (ii) that is adjacent to a county with a
222222 population of 2.5 million or more;
223223 (47) a municipality that is the county seat of a county
224224 bordering the Gulf of Mexico and the United Mexican States;
225225 (48) a municipality that is bisected by the Guadalupe
226226 River and is the county seat of a county with a population of
227227 170,000 or more;
228228 (49) a municipality with a population of 70,000 or
229229 more but less than 150,000 that borders Joe Pool Lake;
230230 (50) a municipality with a population of 115,000 or
231231 more that borders the Neches River;
232232 (51) a municipality described by Section 351.101(k);
233233 (52) a municipality that is the county seat of a
234234 county:
235235 (A) through which the Brazos River flows; and
236236 (B) in which a national monument is located;
237237 (53) a municipality with a population of 45,000 or
238238 more that:
239239 (A) is not the county seat of a county;
240240 (B) is located in a single county; and
241241 (C) contains a portion of Lake Lewisville;
242242 (54) a municipality that is the county seat of a county
243243 with a population of more than 900,000 that is adjacent to two
244244 counties, each of which has a population of more than 1.8 million;
245245 (55) a municipality that hosts an annual wine festival
246246 and is located in three counties, each of which has a population of
247247 more than 900,000;
248248 (56) a municipality that has a population of at least
249249 150,000 but less than 1,300,000 and is partially located in a county
250250 that contains a portion of Cedar Creek Reservoir;
251251 (57) a municipality that is located in a county that
252252 contains a portion of Cedar Creek Reservoir and in which a private
253253 college is located;
254254 (58) a municipality that is the county seat of a
255255 county:
256256 (A) with a population of one million or more;
257257 (B) in which all or part of a municipality with a
258258 population of one million or more is located; and
259259 (C) that is located adjacent to a county with a
260260 population of 2.5 million or more;
261261 (59) a municipality that is the county seat of a county
262262 that contains a portion of Cedar Creek Reservoir and borders a
263263 county with a population of more than 240,000;
264264 (60) a municipality with a population of more than
265265 80,000 but less than 150,000 that is located in a county with a
266266 population of more than 369,000 but less than 864,000 that contains
267267 part of an active duty United States Army installation;
268268 (61) a municipality with a population of 750,000 or
269269 more that is located in a county with a population of 1.5 million or
270270 less;
271271 (62) a municipality with a population of less than
272272 7,000 that contains a country music hall of fame;
273273 (63) a municipality with a population of 35,000 or
274274 more that contains a railroad museum and is located in a county
275275 that:
276276 (A) has a population of 800,000 or more; and
277277 (B) is adjacent to a county with a population of
278278 four million or more; [and]
279279 (64) a municipality:
280280 (A) that is the county seat of a county:
281281 (i) with a population of 60,000 or less; and
282282 (ii) that borders the Rio Grande; and
283283 (B) in which is located a United States military
284284 fort listed in the National Register of Historic Places; and
285285 (65) a municipality that is the county seat of a county
286286 that:
287287 (A) has a population of 600,000 or more; and
288288 (B) is adjacent to the county that contains the
289289 State Capitol.
290290 SECTION 2. Section 351.157(b), Tax Code, is amended to read
291291 as follows:
292292 (b) This section applies only to:
293293 (1) a municipality described by Section 351.152(3);
294294 (1-a) a municipality described by Section 351.152(5);
295295 (2) a municipality described by Section 351.152(6);
296296 (3) a municipality described by Section 351.152(7);
297297 (4) a municipality described by Section 351.152(10);
298298 (4-a) a municipality described by Section
299299 351.152(14);
300300 (5) a municipality described by Section 351.152(16);
301301 (6) a municipality described by Section 351.152(22);
302302 (7) a municipality described by Section 351.152(25);

320320 SECTION 3. This Act takes effect immediately if it receives
321321 a vote of two-thirds of all the members elected to each house, as
322322 provided by Section 39, Article III, Texas Constitution. If this
323323 Act does not receive the vote necessary for immediate effect, this
324324 Act takes effect September 1, 2025.
