77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to electronic voter registration.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 13, Election Code, is
1212 amended by adding Section 13.009 to read as follows:
1313 Sec. 13.009. ELECTRONIC VOTER REGISTRATION. (a) The
1414 secretary of state shall work with the Department of Public Safety
1515 and the Department of Information Resources to implement a program
1616 to allow a person to complete a voter registration application over
1717 the Internet from the official website of this state. The Internet
1818 websites of the secretary of state and the Department of Public
1919 Safety must also provide a link to the location of the application
2020 on the official website of this state.
2121 (b) An applicant for electronic voter registration who has
2222 an unexpired driver's license or personal identification card
2323 issued in this state must:
2424 (1) attest to the truth of the information provided on
2525 the application by affirmatively accepting the information as true;
2626 and
2727 (2) affirmatively consent to the use of the signature
2828 on the applicant's driver's license or personal identification card
2929 for voter registration purposes.
3030 (c) An applicant for electronic voter registration who does
3131 not have an unexpired driver's license or personal identification
3232 card issued in this state must:
3333 (1) attest to the truth of the information provided on
3434 the application by affirmatively accepting the information as true;
3535 and
3636 (2) digitally sign the applicant's application before
3737 submitting it electronically.
3838 (d) For each application submitted under Subsection (b),
3939 the program shall require that a digital copy of the applicant's
4040 signature be obtained from the Department of Public Safety.
4141 (e) A digital signature given as provided by secretary of
4242 state rule meets the signature requirement under Section 13.002(b).
4343 An application submitted under this section is considered for all
4444 purposes an application submitted by mail under this title.
4545 (f) The secretary of state shall adopt rules as necessary to
4646 implement this section, including rules to provide for additional
4747 security measures necessary to ensure the accuracy and integrity of
4848 applications submitted electronically.
4949 (g) The rules adopted under Subsection (f) must require
5050 that:
5151 (1) the Internet website through which a person may
5252 complete a voter registration application include a description of
5353 the offense described by Section 13.007 in a conspicuous location
5454 on the website near the place where the person begins or submits the
5555 application; and
5656 (2) the state electronic Internet portal project be
5757 used to authenticate the identity and address of a person who
5858 submits an application electronically under this section.
5959 SECTION 2. Section 13.042(c), Election Code, is amended to
6060 read as follows:
6161 (c) An application submitted after the 27th [34th] day
6262 before the date of an election and on or before the last day for a
6363 person to timely submit a registration application for that
6464 election as provided by Section 13.143 shall be delivered not later
6565 than 5 p.m. of the next regular business day after the date to
6666 timely submit a registration application for that election as
6767 provided by Section 13.143.
6868 SECTION 3. Sections 13.143(a) and (e), Election Code, are
6969 amended to read as follows:
7070 (a) Except as provided by Subsections (b) and (e), if an
7171 applicant's registration application is approved, the registration
7272 becomes effective on the 23rd [30th] day after the date the
7373 application is submitted to the registrar or on the date the
7474 applicant becomes 18 years of age, whichever is later.
7575 (e) If the 23rd [30th] day before the date of an election is
7676 a Saturday, Sunday, or legal state or national holiday, an
7777 application is considered to be timely if it is submitted to the
7878 registrar on or before the next regular business day.
7979 SECTION 4. This Act takes effect September 1, 2025.
