|---|

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter H, Chapter 36, Utilities Code, is |
|---|
| 14 | 14 | | amended by adding Section 36.3511 to read as follows: |
|---|
| 15 | 15 | | Sec. 36.3511. DISCOUNTED RATES FOR PUBLIC SCHOOL DISTRICTS |
|---|
| 16 | 16 | | AND OTHER POLITICAL SUBDIVISIONS IN CERTAIN COUNTIES. (a) This |
|---|
| 17 | 17 | | section applies only to a facility receiving electric service in a |
|---|
| 18 | 18 | | county that is located on the international border and contains a |
|---|
| 19 | 19 | | municipality with a population of 500,000 or more. |
|---|
| 20 | 20 | | (b) Notwithstanding any other provision of this title, each |
|---|
| 21 | 21 | | electric utility and municipally owned utility shall provide to a |
|---|
| 22 | 22 | | facility of a public school district or another political |
|---|
| 23 | 23 | | subdivision that is authorized to impose an ad valorem tax the same |
|---|
| 24 | 24 | | discount for charges for electric service as the discount required |
|---|
| 25 | 25 | | to be provided to a facility of an institution of higher education |
|---|
| 26 | 26 | | under Section 36.351. |
|---|
| 27 | 27 | | (c) An electric or municipally owned utility is exempt from |
|---|
| 28 | 28 | | this section if the discount results in a reduction equal to more |
|---|
| 29 | 29 | | than one percent of the utility's total annual revenues. |
|---|
| 30 | 30 | | (d) An electric utility may not recover from residential |
|---|
| 31 | 31 | | customers or any other customer class the assigned and allocated |
|---|
| 32 | 32 | | costs of serving a public school district or other political |
|---|
| 33 | 33 | | subdivision that receives a discount under this section. |
|---|
| 34 | 34 | | (e) Each electric utility shall file tariffs with the |
|---|
| 35 | 35 | | commission reflecting the discount required under this section. |
|---|
| 36 | 36 | | The initial tariff filing is not a rate change for purposes of |
|---|
| 37 | 37 | | Subchapter C. |
|---|
| 38 | 38 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 39 | 39 | | a contract entered into on or after the effective date of this Act. |
|---|
| 40 | 40 | | A contract entered into before the effective date of this Act is |
|---|
| 41 | 41 | | governed by the law as it existed immediately before the effective |
|---|
| 42 | 42 | | date of this Act, and that law is continued in effect for that |
|---|
| 43 | 43 | | purpose. |
|---|
| 44 | 44 | | SECTION 3. This Act takes effect September 1, 2025. |
|---|
