77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to rates for electric service provided to public school
1010 districts and other local governmental entities in certain
1111 counties.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter H, Chapter 36, Utilities Code, is
1414 amended by adding Section 36.3511 to read as follows:
1515 Sec. 36.3511. DISCOUNTED RATES FOR PUBLIC SCHOOL DISTRICTS
1616 AND OTHER POLITICAL SUBDIVISIONS IN CERTAIN COUNTIES. (a) This
1717 section applies only to a facility receiving electric service in a
1818 county that is located on the international border and contains a
1919 municipality with a population of 500,000 or more.
2020 (b) Notwithstanding any other provision of this title, each
2121 electric utility and municipally owned utility shall provide to a
2222 facility of a public school district or another political
2323 subdivision that is authorized to impose an ad valorem tax the same
2424 discount for charges for electric service as the discount required
2525 to be provided to a facility of an institution of higher education
2626 under Section 36.351.
2727 (c) An electric or municipally owned utility is exempt from
2828 this section if the discount results in a reduction equal to more
2929 than one percent of the utility's total annual revenues.
3030 (d) An electric utility may not recover from residential
3131 customers or any other customer class the assigned and allocated
3232 costs of serving a public school district or other political
3333 subdivision that receives a discount under this section.
3434 (e) Each electric utility shall file tariffs with the
3535 commission reflecting the discount required under this section.
3636 The initial tariff filing is not a rate change for purposes of
3737 Subchapter C.
3838 SECTION 2. The changes in law made by this Act apply only to
3939 a contract entered into on or after the effective date of this Act.
4040 A contract entered into before the effective date of this Act is
4141 governed by the law as it existed immediately before the effective
4242 date of this Act, and that law is continued in effect for that
4343 purpose.
4444 SECTION 3. This Act takes effect September 1, 2025.
