77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the establishment of the Texas prekindergarten fund to
1010 support public school prekindergarten education.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter E, Chapter 29, Education Code, is
1313 amended by adding Section 29.1555 to read as follows:
1414 Sec. 29.1555. TEXAS PREKINDERGARTEN FUND. (a) In this
1515 section, "fund" means the Texas prekindergarten fund established
1616 under this section.
1717 (b) The Texas prekindergarten fund is a dedicated account in
1818 the general revenue fund.
1919 (c) The fund consists of:
2020 (1) money appropriated or transferred to the fund;
2121 (2) any revenue that by law is dedicated for deposit to
2222 the credit of the fund;
2323 (3) interest and investment earnings on money in the
2424 fund; and
2525 (4) money from gifts, grants, or donations to the
2626 fund.
2727 (d) Money in the fund may be used only to:
2828 (1) expand access to high quality prekindergarten
2929 programs for eligible children;
3030 (2) provide financial assistance to school districts
3131 and open-enrollment charter schools that offer prekindergarten;
3232 (3) support professional development and training for
3333 teachers who teach prekindergarten; and
3434 (4) enhance facilities and instructional resources
3535 for prekindergarten programs.
3636 (e) The agency shall allocate money appropriated from the
3737 fund to school districts and open-enrollment charter schools:
3838 (1) based on:
3939 (A) the percentage of educationally
4040 disadvantaged students enrolled in the district or school;
4141 (B) geographic and demographic needs at the
4242 district or school; and
4343 (C) the district's or school's compliance with
4444 the standards for high quality prekindergarten programs under
4545 Subchapter E-1; and
4646 (2) prioritizing districts and schools that:
4747 (A) serve low-income families;
4848 (B) serve rural and underserved communities; or
4949 (C) offer a prekindergarten program that
5050 demonstrates high performance in early childhood education
5151 outcomes.
5252 (f) Not later than September 1 of each year, the agency
5353 shall submit to the governor and the legislature a report on:
5454 (1) the distribution of money appropriated from the
5555 fund during the preceding school year;
5656 (2) the impact of prekindergarten programs that
5757 received money appropriated from the fund on student performance
5858 during the preceding school year; and
5959 (3) recommendations for legislative or other action.
6060 (g) The commissioner shall adopt rules as necessary to
6161 implement this section.
6262 SECTION 2. This Act takes effect September 1, 2025.
