77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the regulation of building products by governmental
1010 entities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Chapter 3000, Government Code, is
1313 amended to read as follows:
1414 CHAPTER 3000. GOVERNMENTAL ACTION AFFECTING RESIDENTIAL [AND
1515 COMMERCIAL] CONSTRUCTION
1616 SECTION 2. Sections 3000.002(a) and (b), Government Code,
1717 are amended to read as follows:
1818 (a) Notwithstanding any other law and except as provided by
1919 Subsection (d), a governmental entity may not adopt or enforce a
2020 rule, charter provision, ordinance, order, building code, or other
2121 regulation that:
2222 (1) prohibits or limits, directly or indirectly, the
2323 use or installation of a building product or material in the
2424 construction, renovation, maintenance, or other alteration of a
2525 residential [or commercial] building if the building product or
2626 material is approved for use by a national model code published
2727 within the last three code cycles that applies to the construction,
2828 renovation, maintenance, or other alteration of the building; or
2929 (2) establishes a standard for a building product,
3030 material, or aesthetic method in construction, renovation,
3131 maintenance, or other alteration of a residential [or commercial]
3232 building if the standard is more stringent than a standard for the
3333 product, material, or aesthetic method under a national model code
3434 published within the last three code cycles that applies to the
3535 construction, renovation, maintenance, or other alteration of the
3636 building.
3737 (b) A governmental entity that adopts a building code
3838 governing the construction, renovation, maintenance, or other
3939 alteration of a residential [or commercial] building may amend a
4040 provision of the building code to conform to local concerns [if the
4141 amendment does not conflict with Subsection (a)].
4242 SECTION 3. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2025.
