78 AN ACT
89 relating to the use of automated traffic control systems by local
910 authorities and law enforcement agencies.
1011 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1112 SECTION 1. Section 542.2035, Transportation Code, is
1213 amended to read as follows:
1314 Sec. 542.2035. LIMITATION ON LOCAL AUTHORITIES AND LAW
1415 ENFORCEMENT AGENCIES [MUNICIPALITIES]. (a) Except as provided by
1516 Subsection (b), a local authority or law enforcement agency [A
1617 municipality] may not implement or operate an automated traffic
1718 control system with respect to a highway or street under its
1819 jurisdiction for the purpose of enforcing compliance with traffic
1920 laws [posted speed limits]. The attorney general shall enforce
2021 this subsection.
2122 (b) Notwithstanding Subsection (a), and subject to
2223 Subsection (c), a local authority or law enforcement agency may
2324 implement or operate an automated traffic control system with
2425 respect to a highway or street under its jurisdiction for the
2526 purpose of enforcing compliance with traffic laws, including posted
2627 speed limits, in a construction or maintenance work zone. A local
2728 authority or law enforcement agency that implements or operates an
2829 automated traffic control system under this subsection shall adopt
2930 policies requiring the prompt deletion of data produced by that
3031 system that is not related to an active criminal or civil
3132 investigation or proceeding.
3233 (c) A local authority or law enforcement agency may issue a
3334 citation for a violation of a traffic law detected using an
3435 automated traffic control system under Subsection (b) only if:
3536 (1) the citation is issued by a peace officer at the
3637 time of the violation; and
3738 (2) signs that comply with the requirements of
3839 Subsection (d) are posted at the time of the violation.
39- (d) A citation issued under this section may not be mailed
40- or transmitted electronically to a violator after the time of the
41- violation.

4846 (1) indicate an automated traffic control system is
4947 actively being used to monitor motor vehicles in the construction
5048 or maintenance work zone; and
5149 (2) conform to the manual and specifications adopted
5250 under Section 544.001.

5452 (1) "Automated [automated] traffic control system"
5553 means a photographic device, radar device, laser device, or other
5654 electrical or mechanical device designed to:
5755 (A) [(1)] record the speed of a motor vehicle;
5856 and
5957 (B) [(2)] obtain one or more photographs or other
6058 recorded images of:
6159 (i) [(A)] the vehicle;
6260 (ii) [(B)] the license plate attached to
6361 the vehicle; or
6462 (iii) [(C)] the operator of the vehicle.
6563 (2) "Construction or maintenance work zone" has the
6664 meaning assigned by Section 472.022.
6765 (3) "Law enforcement agency" has the meaning assigned
6866 by Article 2B.0053, Code of Criminal Procedure.
6967 (4) "Traffic law" has the meaning assigned by Section
7068 702.001.
7169 SECTION 2. Chapter 707, Transportation Code, is amended by
7270 adding Section 707.022 to read as follows:
7371 Sec. 707.022. CONSTRUCTION OR MAINTENANCE WORK ZONE
7472 EXCEPTION. This chapter does not apply to an automated traffic
7573 control system, as defined by Section 542.2035, that is authorized
7674 by Section 542.2035(b).
7775 SECTION 3. This Act takes effect September 1, 2025.
