8 | 8 | | relating to the responsibilities of the tabulation supervisor of a |

9 | 9 | | central counting station; providing a civil penalty |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 127.003, Election Code, is amended to |
---|
12 | 12 | | read as follows: |
---|
13 | 13 | | Sec. 127.003. TABULATION SUPERVISOR. (a) The authority |
---|
14 | 14 | | establishing a central counting station shall appoint a tabulation |
---|
15 | 15 | | supervisor of the station. Except as otherwise provided by this |
---|
16 | 16 | | section, the eligibility requirements prescribed by this code for |
---|
17 | 17 | | precinct election judges apply to a person appointed under this |
---|
18 | 18 | | section. |
---|
19 | 19 | | (b) To be eligible for appointment, a person must be: |
---|
20 | 20 | | (1) trained in the operation of the automatic |
---|
21 | 21 | | tabulating equipment installed at the counting station; and |
---|
22 | 22 | | (2) a registered voter of the political subdivision |
---|
23 | 23 | | served by the authority establishing the counting station or an |
---|
24 | 24 | | employee of the political subdivision that adopts or owns the |
---|
25 | 25 | | voting system. |
---|
26 | 26 | | (c) Employees of a political subdivision are not |
---|
27 | 27 | | disqualified from appointment and, if appointed, may be paid |
---|
28 | 28 | | additional compensation for their services. |
---|
29 | 29 | | (d) The tabulation supervisor is in charge of the operation |
---|
30 | 30 | | of the automatic tabulating equipment at the counting station. |
---|
31 | 31 | | (e) The tabulation supervisor is in charge of ensuring that |
---|
32 | 32 | | the counting of ballots shall be conducted continuously until all |
---|
33 | 33 | | the ballots are counted. |
---|
34 | 34 | | (f) A tabulation supervisor commits an offense if the |
---|
35 | 35 | | tabulation supervisor fails to comply with a requirement under this |
---|
36 | 36 | | section. The Attorney General shall assess a civil penalty of $500 |
---|
37 | 37 | | for an offense under this section. The tabulation supervisor shall |
---|
38 | 38 | | be personally liable for any penalties assessed by the Attorney |
---|
39 | 39 | | General. |
---|
40 | 40 | | (g) The tabulation supervisor is entitled to compensation |
---|
41 | 41 | | in an amount fixed by the authority establishing the counting |
---|
42 | 42 | | station. |
---|
43 | 43 | | SECTION 2. This Act takes effect immediately if it receives |
---|
44 | 44 | | a vote of two-thirds of all the members elected to each house, as |
---|
45 | 45 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
46 | 46 | | Act does not receive the vote necessary for immediate effect, this |
---|
47 | 47 | | Act takes effect September 1, 2025. |
