77 AN ACT
88 relating to the responsibilities of the tabulation supervisor of a
99 central counting station; providing a civil penalty
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 127.003, Election Code, is amended to
1212 read as follows:
1313 Sec. 127.003. TABULATION SUPERVISOR. (a) The authority
1414 establishing a central counting station shall appoint a tabulation
1515 supervisor of the station. Except as otherwise provided by this
1616 section, the eligibility requirements prescribed by this code for
1717 precinct election judges apply to a person appointed under this
1818 section.
1919 (b) To be eligible for appointment, a person must be:
2020 (1) trained in the operation of the automatic
2121 tabulating equipment installed at the counting station; and
2222 (2) a registered voter of the political subdivision
2323 served by the authority establishing the counting station or an
2424 employee of the political subdivision that adopts or owns the
2525 voting system.
2626 (c) Employees of a political subdivision are not
2727 disqualified from appointment and, if appointed, may be paid
2828 additional compensation for their services.
2929 (d) The tabulation supervisor is in charge of the operation
3030 of the automatic tabulating equipment at the counting station.
3131 (e) The tabulation supervisor is in charge of ensuring that
3232 the counting of ballots shall be conducted continuously until all
3333 the ballots are counted.
3434 (f) A tabulation supervisor commits an offense if the
3535 tabulation supervisor fails to comply with a requirement under this
3636 section. The Attorney General shall assess a civil penalty of $500
3737 for an offense under this section. The tabulation supervisor shall
3838 be personally liable for any penalties assessed by the Attorney
3939 General.
4040 (g) The tabulation supervisor is entitled to compensation
4141 in an amount fixed by the authority establishing the counting
4242 station.
4343 SECTION 2. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2025.
