| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Section 29.046(a), Education Code, is amended to |
|---|
| 15 | 15 | | read as follows: |
|---|
| 16 | 16 | | (a) Money in an account assigned to a student under Section |
|---|
| 17 | 17 | | 29.045 may be used only for supplemental special education services |
|---|
| 18 | 18 | | and supplemental special education instructional materials |
|---|
| 19 | 19 | | approved by the student's admission, review, and dismissal |
|---|
| 20 | 20 | | committee under Section 29.048(c). |
|---|
| 21 | 21 | | SECTION 2. Section 29.048, Education Code, is amended by |
|---|
| 22 | 22 | | adding Subsection (c) to read as follows: |
|---|
| 23 | 23 | | (c) The admission, review, and dismissal committee of a |
|---|
| 24 | 24 | | student approved for participation in the program shall hold an |
|---|
| 25 | 25 | | admission, review, and dismissal committee meeting for the student |
|---|
| 26 | 26 | | with the student's parent before grant money is assigned to a |
|---|
| 27 | 27 | | student's account under the program to determine and approve the |
|---|
| 28 | 28 | | supplemental special education services and supplemental special |
|---|
| 29 | 29 | | education instructional materials that would best serve the |
|---|
| 30 | 30 | | student. The committee shall provide the student's parent and the |
|---|
| 31 | 31 | | agency the list of approved services and materials for the student. |
|---|
| 32 | 32 | | SECTION 3. This Act applies beginning with the 2025-2026 |
|---|
| 33 | 33 | | school year. |
|---|
| 34 | 34 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2025. |
