88 AN ACT
99 relating to the creation of the Maverick County Regional Mobility
1010 Authority; authorizing a fee.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 370, Transportation Code, is amended by
1313 adding Subchapter L to read as follows:
1414 SUBCHAPTER L. MAVERICK COUNTY REGIONAL MOBILITY AUTHORITY
1515 Sec. 370.451. DEFINITION. In this subchapter, "member
1616 county" means a county located in the territory of the Maverick
1717 County Regional Mobility Authority.
1818 Sec. 370.452. NATURE OF AUTHORITY. (a) The Maverick County
1919 Regional Mobility Authority is an authority organized under this
2020 chapter.
2121 (b) A provision of this chapter that requires the commission
2222 to approve the creation of an authority does not apply to the
2323 Maverick County Regional Mobility Authority.
2424 Sec. 370.453. CONFLICTS WITH OTHER LAW. In the case of a
2525 conflict between this subchapter and other provisions of this
2626 chapter or other law governing regional mobility authorities, this
2727 subchapter controls.
2828 Sec. 370.454. MEMBER COUNTIES. (a) The Maverick County
2929 Regional Mobility Authority initially includes Maverick County.
3030 (b) A county may be added to or withdrawn from the Maverick
3131 County Regional Mobility Authority in the manner provided by
3232 Section 370.0315.
3333 Sec. 370.455. BOARD OF DIRECTORS; TERMS. (a) The governing
3434 body of the Maverick County Regional Mobility Authority is a board
3535 of directors consisting of three directors appointed by the
3636 Commissioners Court of Maverick County.
3737 (b) The commissioners court of each county that is added to
3838 the Maverick County Regional Mobility Authority shall appoint a
3939 number of additional directors to the board determined by agreement
4040 of the member counties to ensure fair representation of political
4141 subdivisions in the member counties.
4242 (c) The board shall elect a director representing Maverick
4343 County as the presiding officer. A director may not serve as
4444 presiding officer for more than two consecutive years.
4545 (d) Directors serve two-year terms, with as near as possible
4646 to one-half of the directors' terms expiring on February 1 of each
4747 year.
4848 Sec. 370.456. INITIAL DIRECTORS. (a) Of the initial
4949 directors, the term of one of the directors expires February 1,
5050 2027, and the terms of two of the directors expire February 1, 2028.
5151 (b) Section 370.455(d) does not apply to an initial
5252 director.
5353 (c) This section expires September 1, 2028.
5454 SECTION 2. Sections 502.402(a) and (b-1), Transportation
5555 Code, are amended to read as follows:
5656 (a) This section applies only to:
5757 (1) a county that:
5858 (A) borders the United Mexican States; and
5959 (B) has a population of more than 250,000;
6060 (2) a county that has a population of more than 1.5
6161 million that is coterminous with a regional mobility authority;
6262 [and]
6363 (3) a county that has a population of more than 190,000
6464 and not more than 1.5 million that is coterminous with a regional
6565 mobility authority; and
6666 (4) a member county of the Maverick County Regional
6767 Mobility Authority, as established under Subchapter L, Chapter 370.
6868 (b-1) The commissioners court of a county described by
6969 Subsection (a)(1), (2), or (3) [(a)] with a population of less than
7070 700,000 may increase the additional fee to an amount that does not
7171 exceed $20 if approved by a majority of the qualified voters of the
7272 county voting on the issue at a referendum election, which the
7373 commissioners court may order and hold for that purpose.
7474 SECTION 3. This Act takes effect January 1, 2026, but only
7575 if the constitutional amendment proposed by the 89th Legislature,
7676 Regular Session, 2025, to authorize the legislature to create a
7777 regional mobility authority by local law is approved by the voters.
7878 If that amendment is not approved by the voters, this Act has no
7979 effect.
