| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Chapter 370, Transportation Code, is amended by |
|---|
| 13 | 13 | | adding Subchapter L to read as follows: |
|---|
| 14 | 14 | | SUBCHAPTER L. MAVERICK COUNTY REGIONAL MOBILITY AUTHORITY |
|---|
| 15 | 15 | | Sec. 370.451. DEFINITION. In this subchapter, "member |
|---|
| 16 | 16 | | county" means a county located in the territory of the Maverick |
|---|
| 17 | 17 | | County Regional Mobility Authority. |
|---|
| 18 | 18 | | Sec. 370.452. NATURE OF AUTHORITY. (a) The Maverick County |
|---|
| 19 | 19 | | Regional Mobility Authority is an authority organized under this |
|---|
| 20 | 20 | | chapter. |
|---|
| 21 | 21 | | (b) A provision of this chapter that requires the commission |
|---|
| 22 | 22 | | to approve the creation of an authority does not apply to the |
|---|
| 23 | 23 | | Maverick County Regional Mobility Authority. |
|---|
| 24 | 24 | | Sec. 370.453. CONFLICTS WITH OTHER LAW. In the case of a |
|---|
| 25 | 25 | | conflict between this subchapter and other provisions of this |
|---|
| 26 | 26 | | chapter or other law governing regional mobility authorities, this |
|---|
| 27 | 27 | | subchapter controls. |
|---|
| 28 | 28 | | Sec. 370.454. MEMBER COUNTIES. (a) The Maverick County |
|---|
| 29 | 29 | | Regional Mobility Authority initially includes Maverick County. |
|---|
| 30 | 30 | | (b) A county may be added to or withdrawn from the Maverick |
|---|
| 31 | 31 | | County Regional Mobility Authority in the manner provided by |
|---|
| 32 | 32 | | Section 370.0315. |
|---|
| 33 | 33 | | Sec. 370.455. BOARD OF DIRECTORS; TERMS. (a) The governing |
|---|
| 34 | 34 | | body of the Maverick County Regional Mobility Authority is a board |
|---|
| 35 | 35 | | of directors consisting of three directors appointed by the |
|---|
| 36 | 36 | | Commissioners Court of Maverick County. |
|---|
| 37 | 37 | | (b) The commissioners court of each county that is added to |
|---|
| 38 | 38 | | the Maverick County Regional Mobility Authority shall appoint a |
|---|
| 39 | 39 | | number of additional directors to the board determined by agreement |
|---|
| 40 | 40 | | of the member counties to ensure fair representation of political |
|---|
| 41 | 41 | | subdivisions in the member counties. |
|---|
| 42 | 42 | | (c) The board shall elect a director representing Maverick |
|---|
| 43 | 43 | | County as the presiding officer. A director may not serve as |
|---|
| 44 | 44 | | presiding officer for more than two consecutive years. |
|---|
| 45 | 45 | | (d) Directors serve two-year terms, with as near as possible |
|---|
| 46 | 46 | | to one-half of the directors' terms expiring on February 1 of each |
|---|
| 47 | 47 | | year. |
|---|
| 48 | 48 | | Sec. 370.456. INITIAL DIRECTORS. (a) Of the initial |
|---|
| 49 | 49 | | directors, the term of one of the directors expires February 1, |
|---|
| 50 | 50 | | 2027, and the terms of two of the directors expire February 1, 2028. |
|---|
| 51 | 51 | | (b) Section 370.455(d) does not apply to an initial |
|---|
| 52 | 52 | | director. |
|---|
| 53 | 53 | | (c) This section expires September 1, 2028. |
|---|
| 54 | 54 | | SECTION 2. Sections 502.402(a) and (b-1), Transportation |
|---|
| 55 | 55 | | Code, are amended to read as follows: |
|---|
| 56 | 56 | | (a) This section applies only to: |
|---|
| 57 | 57 | | (1) a county that: |
|---|
| 58 | 58 | | (A) borders the United Mexican States; and |
|---|
| 59 | 59 | | (B) has a population of more than 250,000; |
|---|
| 60 | 60 | | (2) a county that has a population of more than 1.5 |
|---|
| 61 | 61 | | million that is coterminous with a regional mobility authority; |
|---|
| 62 | 62 | | [and] |
|---|
| 63 | 63 | | (3) a county that has a population of more than 190,000 |
|---|
| 64 | 64 | | and not more than 1.5 million that is coterminous with a regional |
|---|
| 65 | 65 | | mobility authority; and |
|---|
| 66 | 66 | | (4) a member county of the Maverick County Regional |
|---|
| 67 | 67 | | Mobility Authority, as established under Subchapter L, Chapter 370. |
|---|
| 68 | 68 | | (b-1) The commissioners court of a county described by |
|---|
| 69 | 69 | | Subsection (a)(1), (2), or (3) [(a)] with a population of less than |
|---|
| 70 | 70 | | 700,000 may increase the additional fee to an amount that does not |
|---|
| 71 | 71 | | exceed $20 if approved by a majority of the qualified voters of the |
|---|
| 72 | 72 | | county voting on the issue at a referendum election, which the |
|---|
| 73 | 73 | | commissioners court may order and hold for that purpose. |
|---|
| 74 | 74 | | SECTION 3. This Act takes effect January 1, 2026, but only |
|---|
| 75 | 75 | | if the constitutional amendment proposed by the 89th Legislature, |
|---|
| 76 | 76 | | Regular Session, 2025, to authorize the legislature to create a |
|---|
| 77 | 77 | | regional mobility authority by local law is approved by the voters. |
|---|
| 78 | 78 | | If that amendment is not approved by the voters, this Act has no |
|---|
| 79 | 79 | | effect. |
