77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a study on maternal mortality and morbidity among Black
1010 women in this state.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. (a) In this section:
1313 (1) "Department" means the Department of State Health
1414 Services.
1515 (2) "Review committee" means the Texas Maternal
1616 Mortality and Morbidity Review Committee established under Chapter
1717 34, Health and Safety Code.
1818 (b) The review committee and the department shall jointly
1919 conduct a study to evaluate maternal mortality and morbidity among
2020 Black women in this state. In conducting the study, the review
2121 committee and department shall:
2222 (1) compare maternal mortality and morbidity rates
2323 among Black women in this state to maternal mortality and morbidity
2424 rates among each other race and ethnicity;
2525 (2) compare maternal mortality and morbidity rates
2626 among Black women in this state in relation to their socioeconomic
2727 status and education level;
2828 (3) assess the impact of social determinants of
2929 health, including an evaluation of data on pregnancy-related
3030 deaths, pregnancy-related complications almost resulting in death,
3131 and morbidities, to identify any correlation in that data to women
3232 who are uninsured, receive health care coverage under Medicaid, or
3333 receive health care coverage through a private health benefit plan
3434 issuer;
3535 (4) evaluate the impact of the following health
3636 conditions on maternal mortality and morbidity:
3737 (A) cardiac health conditions;
3838 (B) preeclampsia, eclampsia, and other
3939 hypertensive disorders;
4040 (C) hemorrhage;
4141 (D) obesity; and
4242 (E) stress-related health conditions; and
4343 (5) assess the effect on maternal mortality and
4444 morbidity among Black women of implicit biases held by health care
4545 providers against Black individuals.
4646 (c) Based on the results of the study conducted under this
4747 section, the review committee and department shall develop
4848 recommendations to address disparities in maternal mortality and
4949 morbidity among Black women, including recommendations on:
5050 (1) strategies to reduce the incidence of
5151 pregnancy-related deaths and severe maternal morbidity;
5252 (2) patient outreach and education;
5353 (3) health care provider training, including a
5454 recommendation on the potential benefit of training on cultural
5555 competency and implicit biases against Black individuals;
5656 (4) best practices identified as successful in
5757 reducing maternal mortality and morbidity; and
5858 (5) the implementation in this state of programs
5959 operating in other states that have reduced maternal mortality and
6060 morbidity rates.
6161 (d) Not later than September 1, 2026, the review committee
6262 and department shall prepare and submit to the governor, lieutenant
6363 governor, speaker of the house of representatives, and appropriate
6464 standing committees of the legislature a written report summarizing
6565 the results of the study and including the recommendations
6666 developed under this section. The report may be consolidated with
6767 the biennial report required under Section 34.015, Health and
6868 Safety Code.
6969 SECTION 2. This Act expires December 31, 2026.
7070 SECTION 3. This Act takes effect immediately if it receives
7171 a vote of two-thirds of all the members elected to each house, as
7272 provided by Section 39, Article III, Texas Constitution. If this
7373 Act does not receive the vote necessary for immediate effect, this
7474 Act takes effect September 1, 2025.
