| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Section 39.1592(a), Utilities Code, is amended | |
| 13 | 13 | to read as follows: | |
| 14 | 14 | (a) This section applies only to an electric generation | |
| 15 | 15 | facility in the ERCOT power region that is subject to [for which] a | |
| 16 | 16 | standard generator interconnection agreement, [is signed on or | |
| 17 | 17 | after January 1, 2027, that] has been in operation for at least one | |
| 18 | 18 | year, and [that] is not a self-generator. | |
| 19 | 19 | SECTION 2. (a) Sections 52(b) and (c), Chapter 410 (H.B. | |
| 20 | 20 | 1500), Acts of the 88th Legislature, Regular Session, 2023, are | |
| 21 | 21 | repealed. | |
| 22 | 22 | (b) Notwithstanding the deadline provided by Section | |
| 23 | 23 | 39.1592(b), Utilities Code, an owner or operator of an electric | |
| 24 | 24 | generation facility to which Section 39.1592(b), Utilities Code, | |
| 25 | 25 | applies shall make the first demonstration required by Section | |
| 26 | 26 | 39.1592(b), Utilities Code, not later than January 1, 2027. | |
| 27 | 27 | SECTION 3. This Act takes effect September 1, 2025. |
