77 AN ACT
88 relating to the sale and delivery of certain license plates.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 504.851(i), Transportation Code, is
1111 amended to read as follows:
1212 (i) A contract entered into by the department with a private
1313 vendor under this section:
1414 (1) must comply with any law generally applicable to a
1515 contract for services entered into by the department;
1616 (2) must require the private vendor to render at least
1717 quarterly to the department periodic accounts that accurately
1818 detail all material transactions, including information reasonably
1919 required by the department to support fees that are collected by the
2020 vendor, and to regularly remit all money payable to the department
2121 under the contract;
2222 (3) may allow or require the private vendor to
2323 establish an electronic infrastructure coordinated and compatible
2424 with the department's registration system, by which motor vehicle
2525 owners may electronically send and receive applications, other
2626 documents, or required payments, and that, when secure access is
2727 necessary, can be electronically validated by the department; and
2828 (4) must allow for the establishment of a range of
2929 premium embossed specialty license plates to be sourced, marketed,
3030 and sold by the vendor.; and
3131 (5) must allow the private vendor to offer home
3232 delivery as an option to a purchaser for an additional fee. The
3333 private vendor may recover or remit any fees customarily charged by
3434 the county tax assessor-collector for the handling and distribution
3535 of specialty license plates. A purchaser is only eligible for home
3636 delivery if the delivery address matches the vehicle's registered
3737 address on record.
3838 SECTION 2. This Act takes effect September 1, 2025.
