| 8 | 8 | | relating to the sale and delivery of certain license plates. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 504.851(i), Transportation Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (i) A contract entered into by the department with a private |
|---|
| 13 | 13 | | vendor under this section: |
|---|
| 14 | 14 | | (1) must comply with any law generally applicable to a |
|---|
| 15 | 15 | | contract for services entered into by the department; |
|---|
| 16 | 16 | | (2) must require the private vendor to render at least |
|---|
| 17 | 17 | | quarterly to the department periodic accounts that accurately |
|---|
| 18 | 18 | | detail all material transactions, including information reasonably |
|---|
| 19 | 19 | | required by the department to support fees that are collected by the |
|---|
| 20 | 20 | | vendor, and to regularly remit all money payable to the department |
|---|
| 21 | 21 | | under the contract; |
|---|
| 22 | 22 | | (3) may allow or require the private vendor to |
|---|
| 23 | 23 | | establish an electronic infrastructure coordinated and compatible |
|---|
| 24 | 24 | | with the department's registration system, by which motor vehicle |
|---|
| 25 | 25 | | owners may electronically send and receive applications, other |
|---|
| 26 | 26 | | documents, or required payments, and that, when secure access is |
|---|
| 27 | 27 | | necessary, can be electronically validated by the department; and |
|---|
| 28 | 28 | | (4) must allow for the establishment of a range of |
|---|
| 29 | 29 | | premium embossed specialty license plates to be sourced, marketed, |
|---|
| 30 | 30 | | and sold by the vendor.; and |
|---|
| 31 | 31 | | (5) must allow the private vendor to offer home |
|---|
| 32 | 32 | | delivery as an option to a purchaser for an additional fee. The |
|---|
| 33 | 33 | | private vendor may recover or remit any fees customarily charged by |
|---|
| 34 | 34 | | the county tax assessor-collector for the handling and distribution |
|---|
| 35 | 35 | | of specialty license plates. A purchaser is only eligible for home |
|---|
| 36 | 36 | | delivery if the delivery address matches the vehicle's registered |
|---|
| 37 | 37 | | address on record. |
|---|
| 38 | 38 | | SECTION 2. This Act takes effect September 1, 2025. |
