10 | 10 | | school district administrators; providing a civil penalty. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter A, Chapter 11, Education Code, is |
---|
13 | 13 | | amended by adding Section 11.006 to read as follows: |
---|
14 | 14 | | Sec. 11.006. PROHIBITED ACTIVITIES BY ADMINISTRATORS. (a) |
---|
15 | 15 | | In this section, "administrator" means a person who has significant |
---|
16 | 16 | | administrative duties relating to the operation of a school |
---|
17 | 17 | | district, including the operation of a campus, program, or other |
---|
18 | 18 | | subdivision of the district. The term does not include a school |
---|
19 | 19 | | district employee whose employment contract responsibilities |
---|
20 | 20 | | primarily include the in-classroom instruction of students. |
---|
21 | 21 | | (b) An administrator may not perform personal services or |
---|
22 | 22 | | receive any financial benefit for the performance of personal |
---|
23 | 23 | | services for: |
---|
24 | 24 | | (1) any business entity that conducts or solicits |
---|
25 | 25 | | business with the school district that employs the administrator; |
---|
26 | 26 | | (2) an education business that provides services |
---|
27 | 27 | | regarding the curriculum or administration of any school district; |
---|
28 | 28 | | or |
---|
29 | 29 | | (3) another school district, open-enrollment charter |
---|
30 | 30 | | school, regional education service center, or public or private |
---|
31 | 31 | | institution of higher education. |
---|
32 | 32 | | (c) An administrator who violates this section is liable to |
---|
33 | 33 | | the state for a civil penalty in the amount of $10,000 for each |
---|
34 | 34 | | violation. |
---|
35 | 35 | | SECTION 2. Section 11.201(e), Education Code, is repealed. |
---|
36 | 36 | | SECTION 3. This Act takes effect immediately if it receives |
---|
37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
---|
38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
---|
40 | 40 | | Act takes effect September 1, 2025. |
