88 AN ACT
99 relating to the provision by school districts of certain records
1010 and financial information to the public.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter Z, Chapter 44, Education Code, is
1313 amended by adding Section 44.906 to read as follows:
1414 Sec. 44.906. TRANSPARENCY OF PUBLIC INFORMATION; ONLINE
1515 PORTAL. (a) For the purpose of streamlining and minimizing
1616 requests for public information and reducing the associated costs
1717 of fulfilling those requests, a school district shall establish,
1818 maintain, and update regularly on the district's Internet website a
1919 publicly accessible online portal developed in a user-friendly
2020 format that allows a person to access a repository of critical
2121 documents relating to the district's operations in real time
2222 through interactive dashboards and data visualization tools.
2323 (b) The online portal must be searchable and allow a person
2424 to specify the records sought, including by keywords, date ranges,
2525 and document types.
2626 (c) The repository of critical documents must include:
2727 (1) a copy of each contract and consulting agreement
2828 entered into by the district, including:
2929 (A) procurement records required by state law;
3030 (B) the total value of the contract;
3131 (C) change orders;
3232 (D) payment applications;
3333 (E) project timelines;
3434 (F) conflict of interest disclosures;
3535 (G) information regarding the selection process
3636 for the contractor or consultant, as applicable; and
3737 (H) any other key construction documents;
3838 (2) a disclosure of the district's investment
3939 policies, including information regarding:
4040 (A) investment objectives;
4141 (B) risk tolerance;
4242 (C) diversification strategies; and
4343 (D) fee structures;
4444 (3) regular performance reports on the district's
4545 investment portfolio, including information regarding:
4646 (A) returns;
4747 (B) fees paid;
4848 (C) benchmark comparisons; and
4949 (D) any company that employs a person involved in
5050 buying, selling, or trading district bonds;
5151 (4) the minutes, certified agenda, or recording, as
5252 applicable, of each regular or special meeting of the district's
5353 board of trustees, including a document in a portable document
5454 format (PDF) of each agenda item, if available; and
5555 (5) the district's financial reports.
5656 (d) Not later than 30 days after the date a school district
5757 creates, receives, or modifies a document described by Subsection
5858 (c), the district shall update the repository of critical documents
5959 accordingly.
6060 SECTION 2. This Act takes effect immediately if it receives
6161 a vote of two-thirds of all the members elected to each house, as
6262 provided by Section 39, Article III, Texas Constitution. If this
6363 Act does not receive the vote necessary for immediate effect, this
6464 Act takes effect September 1, 2025.
