| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 252.005, Election Code, is amended to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | Sec. 252.005. AUTHORITY WITH WHOM APPOINTMENT FILED: |
|---|
| 16 | 16 | | CANDIDATE. An individual must file a campaign treasurer |
|---|
| 17 | 17 | | appointment for the individual's own candidacy with: |
|---|
| 18 | 18 | | (1) the commission, if the appointment is made for |
|---|
| 19 | 19 | | candidacy for: |
|---|
| 20 | 20 | | (A) a statewide office; |
|---|
| 21 | 21 | | (B) a district office filled by voters of more |
|---|
| 22 | 22 | | than one county; |
|---|
| 23 | 23 | | (C) a judicial district office filled by voters |
|---|
| 24 | 24 | | of only one county; |
|---|
| 25 | 25 | | (D) state senator; |
|---|
| 26 | 26 | | (E) state representative; or |
|---|
| 27 | 27 | | (F) the State Board of Education; |
|---|
| 28 | 28 | | (2) the county clerk or, for counties having the |
|---|
| 29 | 29 | | position, the county elections administrator, if the appointment is |
|---|
| 30 | 30 | | made for candidacy for: |
|---|
| 31 | 31 | | (A) a county office; [,] |
|---|
| 32 | 32 | | (B) a precinct office; [,] |
|---|
| 33 | 33 | | (C) an elected position on the board of directors |
|---|
| 34 | 34 | | of an appraisal district to which Section 6.0301, Tax Code, |
|---|
| 35 | 35 | | applies; or |
|---|
| 36 | 36 | | (D) a district office other than one included in |
|---|
| 37 | 37 | | Subdivision (1); |
|---|
| 38 | 38 | | (3) except as otherwise provided by this section, the |
|---|
| 39 | 39 | | clerk or secretary of the governing body of the political |
|---|
| 40 | 40 | | subdivision or, if the political subdivision has no clerk or |
|---|
| 41 | 41 | | secretary, with the governing body's presiding officer, if the |
|---|
| 42 | 42 | | appointment is made for candidacy for an office of a political |
|---|
| 43 | 43 | | subdivision other than a county; |
|---|
| 44 | 44 | | (4) the county clerk if: |
|---|
| 45 | 45 | | (A) the appointment is made for candidacy for an |
|---|
| 46 | 46 | | office of a political subdivision other than a county; |
|---|
| 47 | 47 | | (B) the governing body for the political |
|---|
| 48 | 48 | | subdivision has not been formed; and |
|---|
| 49 | 49 | | (C) no boundary of the political subdivision |
|---|
| 50 | 50 | | crosses a boundary of the county; or |
|---|
| 51 | 51 | | (5) the commission if: |
|---|
| 52 | 52 | | (A) the appointment is made for candidacy for an |
|---|
| 53 | 53 | | office of a political subdivision other than a county; |
|---|
| 54 | 54 | | (B) the governing body for the political |
|---|
| 55 | 55 | | subdivision has not been formed; and |
|---|
| 56 | 56 | | (C) the political subdivision is situated in more |
|---|
| 57 | 57 | | than one county. |
|---|
| 58 | 58 | | SECTION 2. Section 6.032(b), Tax Code, is amended to read as |
|---|
| 59 | 59 | | follows: |
|---|
| 60 | 60 | | (b) An application for a place on the ballot must be filed |
|---|
| 61 | 61 | | with the county clerk or, for counties having the position, the |
|---|
| 62 | 62 | | county elections administrator [judge] of the county in which the |
|---|
| 63 | 63 | | appraisal district is established and be accompanied by a filing |
|---|
| 64 | 64 | | fee prescribed by Subsection (c) of this section or a petition in |
|---|
| 65 | 65 | | lieu of the filing fee that satisfies the requirements prescribed |
|---|
| 66 | 66 | | by Section 141.062, Election Code, and Subsection (d) of this |
|---|
| 67 | 67 | | section. |
|---|
| 68 | 68 | | SECTION 3. Section 252.005, Election Code, as amended by |
|---|
| 69 | 69 | | this Act, applies only to a campaign treasurer appointment required |
|---|
| 70 | 70 | | to be filed under Chapter 252, Election Code, on or after the |
|---|
| 71 | 71 | | effective date of this Act. A campaign treasurer appointment |
|---|
| 72 | 72 | | required to be filed before the effective date of this Act is |
|---|
| 73 | 73 | | governed by the law in effect on the date the appointment was filed, |
|---|
| 74 | 74 | | and the former law is continued in effect for that purpose. |
|---|
| 75 | 75 | | SECTION 4. Section 6.032, Tax Code, as amended by this Act, |
|---|
| 76 | 76 | | applies only to an application for a place on the ballot for a |
|---|
| 77 | 77 | | position on the board of directors of an appraisal district |
|---|
| 78 | 78 | | required to be filed on or after the effective date of this Act. An |
|---|
| 79 | 79 | | application required to be filed before the effective date of this |
|---|
| 80 | 80 | | Act is governed by the law in effect on the date the application was |
|---|
| 81 | 81 | | filed, and the former law is continued in effect for that purpose. |
|---|
| 82 | 82 | | SECTION 5. This Act takes effect September 1, 2025. |
