77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the filing of a campaign treasurer appointment and an
1010 application for a place on the ballot by a candidate for the board
1111 of directors of an appraisal district.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 252.005, Election Code, is amended to
1414 read as follows:
1515 Sec. 252.005. AUTHORITY WITH WHOM APPOINTMENT FILED:
1616 CANDIDATE. An individual must file a campaign treasurer
1717 appointment for the individual's own candidacy with:
1818 (1) the commission, if the appointment is made for
1919 candidacy for:
2020 (A) a statewide office;
2121 (B) a district office filled by voters of more
2222 than one county;
2323 (C) a judicial district office filled by voters
2424 of only one county;
2525 (D) state senator;
2626 (E) state representative; or
2727 (F) the State Board of Education;
2828 (2) the county clerk or, for counties having the
2929 position, the county elections administrator, if the appointment is
3030 made for candidacy for:
3131 (A) a county office; [,]
3232 (B) a precinct office; [,]
3333 (C) an elected position on the board of directors
3434 of an appraisal district to which Section 6.0301, Tax Code,
3535 applies; or
3636 (D) a district office other than one included in
3737 Subdivision (1);
3838 (3) except as otherwise provided by this section, the
3939 clerk or secretary of the governing body of the political
4040 subdivision or, if the political subdivision has no clerk or
4141 secretary, with the governing body's presiding officer, if the
4242 appointment is made for candidacy for an office of a political
4343 subdivision other than a county;
4444 (4) the county clerk if:
4545 (A) the appointment is made for candidacy for an
4646 office of a political subdivision other than a county;
4747 (B) the governing body for the political
4848 subdivision has not been formed; and
4949 (C) no boundary of the political subdivision
5050 crosses a boundary of the county; or
5151 (5) the commission if:
5252 (A) the appointment is made for candidacy for an
5353 office of a political subdivision other than a county;
5454 (B) the governing body for the political
5555 subdivision has not been formed; and
5656 (C) the political subdivision is situated in more
5757 than one county.
5858 SECTION 2. Section 6.032(b), Tax Code, is amended to read as
5959 follows:
6060 (b) An application for a place on the ballot must be filed
6161 with the county clerk or, for counties having the position, the
6262 county elections administrator [judge] of the county in which the
6363 appraisal district is established and be accompanied by a filing
6464 fee prescribed by Subsection (c) of this section or a petition in
6565 lieu of the filing fee that satisfies the requirements prescribed
6666 by Section 141.062, Election Code, and Subsection (d) of this
6767 section.
6868 SECTION 3. Section 252.005, Election Code, as amended by
6969 this Act, applies only to a campaign treasurer appointment required
7070 to be filed under Chapter 252, Election Code, on or after the
7171 effective date of this Act. A campaign treasurer appointment
7272 required to be filed before the effective date of this Act is
7373 governed by the law in effect on the date the appointment was filed,
7474 and the former law is continued in effect for that purpose.
7575 SECTION 4. Section 6.032, Tax Code, as amended by this Act,
7676 applies only to an application for a place on the ballot for a
7777 position on the board of directors of an appraisal district
7878 required to be filed on or after the effective date of this Act. An
7979 application required to be filed before the effective date of this
8080 Act is governed by the law in effect on the date the application was
8181 filed, and the former law is continued in effect for that purpose.
8282 SECTION 5. This Act takes effect September 1, 2025.
