| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 209.00591, Property Code, is amended by |
|---|
| 14 | 14 | | adding Subsection (a-4) to read as follows: |
|---|
| 15 | 15 | | (a-4) A person may not serve as the presiding officer of the |
|---|
| 16 | 16 | | board of a property owners' association if that person is serving as |
|---|
| 17 | 17 | | the president of the board of a municipal utility district. |
|---|
| 18 | 18 | | SECTION 2. Subchapter C, Chapter 54, Water Code, is amended |
|---|
| 19 | 19 | | by adding Section 54.103 to read as follows: |
|---|
| 20 | 20 | | Sec. 54.103. DISQUALIFICATION OF DIRECTOR FOR PRESIDENT. A |
|---|
| 21 | 21 | | person is disqualified from serving as the president of the board if |
|---|
| 22 | 22 | | that person is serving as the presiding officer of the board of a |
|---|
| 23 | 23 | | property owners' association under Chapter 209, Property Code. |
|---|
| 24 | 24 | | SECTION 3. Sections 209.00591(a-4), Property Code, and |
|---|
| 25 | 25 | | 54.103, Water Code, as added by this Act, apply only to a person |
|---|
| 26 | 26 | | elected or appointed to serve as the presiding officer of the board |
|---|
| 27 | 27 | | of a property owners' association or president of the board of a |
|---|
| 28 | 28 | | municipal utility district on or after the effective date of this |
|---|
| 29 | 29 | | Act. |
|---|
| 30 | 30 | | SECTION 4. This Act takes effect September 1, 2025. |
