77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to political advertising distributed or broadcast as part
1010 of a mass text message campaign.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 251.001, Election Code, is amended by
1313 amending Subdivision (16) and adding Subdivision (22) to read as
1414 follows:
1515 (16) "Political advertising" means a communication
1616 supporting or opposing a candidate for nomination or election to a
1717 public office or office of a political party, a political party, a
1818 public officer, or a measure that:
1919 (A) in return for consideration, is published in
2020 a newspaper, magazine, or other periodical or is broadcast by radio
2121 or television or as part of a mass text message campaign; or
2222 (B) appears:
2323 (i) in a pamphlet, circular, flier,
2424 billboard or other sign, bumper sticker, or similar form of written
2525 communication; or
2626 (ii) on an Internet website.
2727 (22) "Mass text message campaign" means an organized
2828 effort in which a person sends a text message to multiple recipients
2929 in support of or opposition to a candidate, a political party, a
3030 public officer, or a measure and which involves an expenditure of
3131 funds for the messages that exceed the basic cost of hardware,
3232 messaging software, and bandwidth.
3333 SECTION 2. The changes in law made by this Act apply only to
3434 political advertising that is distributed or broadcast on or after
3535 the effective date of this Act. The distribution or broadcasting of
3636 political advertising before the effective date of this Act is
3737 governed by the law in effect on the date the political advertising
3838 was distributed or broadcast, and the former law is continued in
3939 effect for that purpose.
4040 SECTION 3. This Act takes effect September 1, 2025.
