77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to prohibitions on the provision to certain children of
1010 gender transitioning or reassignment procedures and treatments and
1111 gender-affirming therapy and counseling; creating criminal
1212 offenses.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 161.701, Health and Safety Code, as
1515 added by Chapter 335 (S.B. 14), Acts of the 88th Legislature,
1616 Regular Session, 2023, is amended by adding Subdivision (3-a) to
1717 read as follows:
1818 (3-a) "Non-physician mental health professional" has
1919 the meaning assigned by Section 571.003.
2020 SECTION 2. Section 161.702, Health and Safety Code, as
2121 added by Chapter 335 (S.B. 14), Acts of the 88th Legislature,
2222 Regular Session, 2023, is amended to read as follows:
2323 Sec. 161.702. PROHIBITED PROVISION OF GENDER TRANSITIONING
2424 OR GENDER REASSIGNMENT PROCEDURES AND TREATMENTS TO CERTAIN
2525 CHILDREN; CRIMINAL PENALTY. (a) For the purpose of transitioning
2626 a child's biological sex as determined by the sex organs,
2727 chromosomes, and endogenous profiles of the child or affirming the
2828 child's perception of the child's sex if that perception is
2929 inconsistent with the child's biological sex, a physician or health
3030 care provider may not knowingly:
3131 (1) perform a surgery that sterilizes the child,
3232 including:
3333 (A) castration;
3434 (B) vasectomy;
3535 (C) hysterectomy;
3636 (D) oophorectomy;
3737 (E) metoidioplasty;
3838 (F) orchiectomy;
3939 (G) penectomy;
4040 (H) phalloplasty; and
4141 (I) vaginoplasty;
4242 (2) perform a mastectomy;
4343 (3) provide, prescribe, administer, or dispense any of
4444 the following prescription drugs that induce transient or permanent
4545 infertility:
4646 (A) puberty suppression or blocking prescription
4747 drugs to stop or delay normal puberty;
4848 (B) supraphysiologic doses of testosterone to
4949 females; or
5050 (C) supraphysiologic doses of estrogen to males;
5151 or
5252 (4) remove any otherwise healthy or non-diseased body
5353 part or tissue.
5454 (b) A person who violates this section commits an offense.
5555 An offense under this section is a state jail felony.
5656 SECTION 3. Subchapter X, Chapter 161, Health and Safety
5757 Code, as added by Chapter 335 (S.B. 14), Acts of the 88th
5858 Legislature, Regular Session, 2023, is amended by adding Sections
5959 161.7035 and 161.7036 to read as follows:
6060 Sec. 161.7035. PROHIBITED PROVISION OF GENDER-AFFIRMING
6161 THERAPY AND COUNSELING; CRIMINAL PENALTY. (a) A non-physician
6262 mental health professional may not provide gender-affirming
6363 therapy or counseling to a child to treat gender dysphoria if the
6464 purpose of the therapy or counseling is to affirm a gender
6565 inconsistent with the child's biological sex, as determined by the
6666 sex organs, chromosomes, and endogenous profiles of the child.
6767 (b) A person who violates this section commits an offense.
6868 An offense under this section is a state jail felony.
6969 Sec. 161.7036. PROHIBITED REFERRAL TO HEALTH CARE
7070 PRACTITIONER IN ANOTHER STATE; CRIMINAL PENALTY. (a) A physician,
7171 health care provider, or non-physician mental health professional
7272 may not refer a child to a health care practitioner licensed or
7373 otherwise authorized to provide health care in another state for
7474 provision of:
7575 (1) a procedure or treatment that violates Section
7676 161.702 if performed in this state; or
7777 (2) therapy or counseling that violates Section
7878 161.7035 if performed in this state.
7979 (b) A person who violates this section commits an offense.
8080 An offense under this section is a state jail felony.
8181 SECTION 4. This Act takes effect September 1, 2025.
