11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter A, Chapter 32, Family Code, is |
---|
13 | 13 | | amended by adding Section 32.006 to read as follows: |
---|
14 | 14 | | Sec. 32.006. ACCESS TO CHILD'S TREATMENT RECORDS. Unless |
---|
15 | 15 | | limited by court order, a child's parent or, if applicable, the |
---|
16 | 16 | | child's managing conservator or guardian, is entitled to access to |
---|
17 | 17 | | the child's medical, dental, psychological, or surgical treatment |
---|
18 | 18 | | records, regardless of whether the parent, managing conservator, or |
---|
19 | 19 | | guardian: |
---|
20 | 20 | | (1) was required to consent to the treatment; or |
---|
21 | 21 | | (2) consented to the treatment. |

22 | 22 | | SECTION 2. Subchapter A, Chapter 181, Health and Safety |
---|
23 | 23 | | Code, is amended by adding Section 181.007 to read as follows: |

24 | 24 | | Sec. 181.007. PARENTAL ACCESS TO MEDICAL RECORDS OF MINOR |
---|
25 | 25 | | CHILD. (a) In this section, "child" means a person younger than 18 |
---|
26 | 26 | | years of age who is not and has not been married or who has not had |
---|
27 | 27 | | the disabilities of minority removed for general purposes. |
---|
28 | 28 | | (b) Nothing in this chapter may be construed to limit the |
---|
29 | 29 | | right of a child's parent or, if applicable, the child's managing |
---|
30 | 30 | | conservator or guardian, to access to the child's health records |
---|
31 | 31 | | under other law. |
---|
32 | 32 | | SECTION 3. This Act takes effect September 1, 2025. |
