77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to access to a child's health records by the child's
1010 parent, managing conservator, or guardian.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 32, Family Code, is
1313 amended by adding Section 32.006 to read as follows:
1414 Sec. 32.006. ACCESS TO CHILD'S TREATMENT RECORDS. Unless
1515 limited by court order, a child's parent or, if applicable, the
1616 child's managing conservator or guardian, is entitled to access to
1717 the child's medical, dental, psychological, or surgical treatment
1818 records, regardless of whether the parent, managing conservator, or
1919 guardian:
2020 (1) was required to consent to the treatment; or
2121 (2) consented to the treatment.
2222 SECTION 2. Subchapter A, Chapter 181, Health and Safety
2323 Code, is amended by adding Section 181.007 to read as follows:
2424 Sec. 181.007. PARENTAL ACCESS TO MEDICAL RECORDS OF MINOR
2525 CHILD. (a) In this section, "child" means a person younger than 18
2626 years of age who is not and has not been married or who has not had
2727 the disabilities of minority removed for general purposes.
2828 (b) Nothing in this chapter may be construed to limit the
2929 right of a child's parent or, if applicable, the child's managing
3030 conservator or guardian, to access to the child's health records
3131 under other law.
3232 SECTION 3. This Act takes effect September 1, 2025.
