77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to instruction in cardiopulmonary resuscitation and the
1010 use of automated external defibrillators for school district,
1111 private school, and open-enrollment charter school employees and
1212 volunteers.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Sections 22.902(c) and (e), Education Code, are
1515 amended to read as follows:
1616 (c) Each school nurse, assistant school nurse, athletic
1717 coach or sponsor, physical education instructor, marching band
1818 director, cheerleading coach, and any other school employee
1919 specified by the commissioner and each student who serves as an
2020 athletic trainer must participate in the instruction in
2121 cardiopulmonary resuscitation and [in] the use of an automated
2222 external defibrillator. A person described by this subsection must
2323 receive and maintain certification in cardiopulmonary
2424 resuscitation and the use of an automated external defibrillator
2525 from the American Heart Association, the American Red Cross, or a
2626 similar nationally recognized association.
2727 (e) [This subsection applies only to a private school that
2828 receives an automated external defibrillator from the agency or
2929 receives funding from the agency to purchase or lease an automated
3030 external defibrillator.] A private school or open-enrollment
3131 charter school shall adopt a policy under which the school makes
3232 available to school employees and volunteers instruction in the
3333 principles and techniques of cardiopulmonary resuscitation and the
3434 use of an automated external defibrillator. The policy must comply
3535 with the requirements prescribed by this section and commissioner
3636 rules adopted under this section, including the requirements
3737 prescribed by Subsection (c).
3838 SECTION 2. This Act applies beginning with the 2025-2026
3939 school year.
4040 SECTION 3. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2025.
