| 12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 13 | 13 | SECTION 1. Section 2303.156, Occupations Code, is amended | |
| 14 | 14 | by adding Subsection (c) to read as follows: | |
| 15 | 15 | (c) An insurance company that pays a claim of total loss on | |
| 16 | 16 | personal property stored at a vehicle storage facility is liable to | |
| 17 | 17 | the operator of the facility for any money owed to the operator in | |
| 18 | 18 | relation to delivery of the property to the facility, storage of the | |
| 19 | 19 | property in the facility, and disposal of the property, regardless | |
| 20 | 20 | of whether an amount accrued before the insurance company paid the | |
| 21 | 21 | claim. | |
| 22 | 22 | SECTION 2. Section 2303.156(c), Occupations Code, as added | |
| 23 | 23 | by this Act, applies only to personal property accepted for storage | |
| 24 | 24 | by a vehicle storage facility on or after the effective date of this | |
| 25 | 25 | Act. | |
| 26 | 26 | SECTION 3. This Act takes effect September 1, 2025. |
