77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to distribution of state traffic fine revenue received by
1010 the comptroller.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 542.4031(g) and (h), Transportation
1313 Code, are amended to read as follows:
1414 (g) Of the money received by the comptroller under this
1515 section, the comptroller shall deposit:
1616 (1) 50 [70] percent to the credit of the undedicated
1717 portion of the general revenue fund; and
1818 (2) 50 [30] percent to the credit of the designated
1919 trauma facility and emergency medical services account under
2020 Section 780.003, Health and Safety Code.
2121 (h) Notwithstanding Subsection (g)(1), in any state fiscal
2222 year the comptroller shall deposit 50 [70] percent of the money
2323 received under Subsection (e)(2) to the credit of the general
2424 revenue fund only until the total amount of the money deposited to
2525 the credit of the general revenue fund under Subsection (g)(1)
2626 equals $250 million for that year. If in any state fiscal year the
2727 amount received by the comptroller under Subsection (e)(2) for
2828 deposit to the credit of the general revenue fund under Subsection
2929 (g)(1) exceeds $250 million, the comptroller shall deposit the
3030 additional amount to the credit of the Texas mobility fund.
3131 SECTION 2. Section 542.4031(g), Transportation Code, as
3232 amended by this Act, applies only to the distribution of revenue
3333 collected on or after the effective date of this Act. The
3434 distribution of revenue collected before the effective date of this
3535 Act is governed by the law in effect at the time the revenue was
3636 collected, and that law is continued in effect for the purpose of
3737 the distribution of that revenue.
3838 SECTION 3. This Act takes effect September 1, 2025.
