77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the bilingual education allotment under the public
1010 school finance system.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 29.054, Education Code, is amended by
1313 adding Subsection (e) to read as follows:
1414 (e) Notwithstanding Section 29.066(c), the agency may
1515 require, for purposes of implementing Section 48.105, a school
1616 district that is granted an exception under this section to:
1717 (1) include in the district's Public Education
1818 Information Management System (PEIMS) report additional
1919 information specified by the agency and relating to the alternative
2020 language education methods used by the district; and
2121 (2) classify the alternative language education
2222 methods used by the district under the Public Education Information
2323 Management System (PEIMS) report as specified by the agency.
2424 SECTION 2. Section 48.105, Education Code, is amended by
2525 adding Subsections (a-1) and (a-2) and amending Subsection (b) to
2626 read as follows:
2727 (a-1) The agency shall review school districts that offer
2828 alternative language education methods approved by the agency under
2929 Section 29.054(d) and approve districts to receive the allotment
3030 under Subsection (a-2) for that biennium in a manner that provides
3131 not more than $10 million total under the allotment to school
3232 districts in each biennium. In approving school districts to
3333 receive the allotment under this subsection, the agency shall, to
3434 the extent possible, approve eligible school districts from a
3535 cross-section of this state.
3636 (a-2) For each student in average daily attendance in an
3737 alternative language education method approved by the agency under
3838 Section 29.054(d), and offered by a school district approved to
3939 receive the allotment under Subsection (a-1), the district is
4040 entitled to an annual allotment equal to the basic allotment
4141 multiplied by:
4242 (1) 0.15 for an emergent bilingual student, as defined
4343 by Section 29.052, if the student is in an alternative language
4444 education method using a dual language immersion/one-way or two-way
4545 program model; and
4646 (2) 0.05 for a student not described by Subdivision
4747 (1), if the student is in an alternative language education method
4848 using a dual language immersion/one-way or two-way program model.
4949 (b) At least 55 percent of the funds allocated under this
5050 section must be used in providing bilingual education or special
5151 language programs under Subchapter B, Chapter 29. A district's
5252 bilingual education or special language allocation may be used only
5353 for program and student evaluation, instructional materials and
5454 equipment, staff development, supplemental staff expenses, teacher
5555 salaries [salary supplements for teachers], incremental costs
5656 associated with providing smaller class sizes, and other supplies
5757 required for quality instruction.
5858 SECTION 3. This Act takes effect September 1, 2025.
