77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the definition of population for the purpose of the
1010 rural sheriff's office, constable's office, and prosecutor's office
1111 salary assistance grant program.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 130.911(a), Local Government Code, is
1414 amended by amending Subdivision (2) and adding Subdivision (3) to
1515 read as follows:
1616 (2) "Population" means the population shown by the
1717 most recent:
1818 (A) federal decennial census; or
1919 (B) annual population estimate provided by the
2020 state demographer under Chapter 468, Government Code, if that
2121 estimate is more recent than the most recent federal decennial
2222 census.
2323 (3) "Qualified county" means a county with a
2424 population of 300,000 or less.
2525 SECTION 2. Section 130.912(a), Local Government Code, is
2626 amended by amending Subdivisions (2) and (3) and adding Subdivision
2727 (4) to read as follows:
2828 (2) "Population" has the meaning assigned by Section
2929 130.911.
3030 (3) "Qualified constable" means a constable elected to
3131 an office created on or before January 1, 2023, who primarily makes
3232 motor vehicle stops in the routine performance of the constable's
3333 duties.
3434 (4) [(3)] "Qualified county" means a county with a
3535 population of 300,000 or less.
3636 SECTION 3. Section 130.913(a), Local Government Code, is
3737 amended by amending Subdivision (2) and adding Subdivision (3) to
3838 read as follows:
3939 (2) "Population" has the meaning assigned by Section
4040 130.911.
4141 (3) "Qualified prosecutor's office" means, in a
4242 jurisdiction with a population of 300,000 or less, the office of a
4343 district attorney, criminal district attorney, or county attorney
4444 with criminal prosecution duties.
4545 SECTION 4. The changes in law made by this Act apply only to
4646 the award of a grant to a county during a fiscal year of the county
4747 that begins on or after the effective date of this Act.
4848 SECTION 5. This Act takes effect immediately if it receives
4949 a vote of two-thirds of all the members elected to each house, as
5050 provided by Section 39, Article III, Texas Constitution. If this
5151 Act does not receive the vote necessary for immediate effect, this
5252 Act takes effect September 1, 2025.
