| 9 | 9 | | relating to the definition of population for the purpose of the |

| 10 | 10 | | rural sheriff's office, constable's office, and prosecutor's office |
|---|
| 11 | 11 | | salary assistance grant program. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 13 | 13 | | SECTION 1. Section 130.911(a), Local Government Code, is |
|---|
| 14 | 14 | | amended by amending Subdivision (2) and adding Subdivision (3) to |
|---|
| 15 | 15 | | read as follows: |
|---|
| 16 | 16 | | (2) "Population" means the population shown by the |
|---|
| 17 | 17 | | most recent: |
|---|
| 18 | 18 | | (A) federal decennial census; or |
|---|
| 19 | 19 | | (B) annual population estimate provided by the |
|---|
| 20 | 20 | | state demographer under Chapter 468, Government Code, if that |
|---|
| 21 | 21 | | estimate is more recent than the most recent federal decennial |
|---|
| 22 | 22 | | census. |
|---|
| 23 | 23 | | (3) "Qualified county" means a county with a |
|---|
| 24 | 24 | | population of 300,000 or less. |
|---|
| 25 | 25 | | SECTION 2. Section 130.912(a), Local Government Code, is |
|---|
| 26 | 26 | | amended by amending Subdivisions (2) and (3) and adding Subdivision |
|---|
| 27 | 27 | | (4) to read as follows: |
|---|
| 28 | 28 | | (2) "Population" has the meaning assigned by Section |
|---|
| 29 | 29 | | 130.911. |
|---|
| 30 | 30 | | (3) "Qualified constable" means a constable elected to |
|---|
| 31 | 31 | | an office created on or before January 1, 2023, who primarily makes |
|---|
| 32 | 32 | | motor vehicle stops in the routine performance of the constable's |
|---|
| 33 | 33 | | duties. |
|---|
| 34 | 34 | | (4) [(3)] "Qualified county" means a county with a |
|---|
| 35 | 35 | | population of 300,000 or less. |
|---|
| 36 | 36 | | SECTION 3. Section 130.913(a), Local Government Code, is |

| 37 | 37 | | amended by amending Subdivision (2) and adding Subdivision (3) to |
|---|

| 41 | 41 | | (3) "Qualified prosecutor's office" means, in a |
|---|
| 42 | 42 | | jurisdiction with a population of 300,000 or less, the office of a |
|---|
| 43 | 43 | | district attorney, criminal district attorney, or county attorney |
|---|
| 44 | 44 | | with criminal prosecution duties. |
|---|
| 45 | 45 | | SECTION 4. The changes in law made by this Act apply only to |
|---|
| 46 | 46 | | the award of a grant to a county during a fiscal year of the county |
|---|
| 47 | 47 | | that begins on or after the effective date of this Act. |
|---|
| 48 | 48 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 49 | 49 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 50 | 50 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 51 | 51 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 52 | 52 | | Act takes effect September 1, 2025. |
