| 8 | 8 | | relating to agreements between border municipalities. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 763.003, Government Code, is amended by |
|---|
| 11 | 11 | | adding Subsections (e) and (f) to read as follows: |
|---|
| 12 | 12 | | (e) An agreement or contract authorized by this chapter may |
|---|
| 13 | 13 | | be memorialized by reciprocal ordinances or ordinances in |
|---|
| 14 | 14 | | substantially similar language enacted by each municipality. |
|---|
| 15 | 15 | | (f) By joint resolution, each municipality may extend the |
|---|
| 16 | 16 | | provisions of this chapter to an agreement or contract that |
|---|
| 17 | 17 | | predates enactment of this chapter. |
|---|
| 18 | 18 | | SECTION 2. Chapter 763, Government Code, is amended by |
|---|
| 19 | 19 | | adding Section 763.006 to read as follows: |
|---|
| 20 | 20 | | Sec. 763.006. ELIGILIBITY FOR FUNDING AND FINANCING |
|---|
| 21 | 21 | | METHODS. Any facility, service, infrastructure, or other real |
|---|
| 22 | 22 | | property created, operated, owned, co-owned, acquired, or governed |
|---|
| 23 | 23 | | by an agreement authorized by this chapter, if located in the state |
|---|
| 24 | 24 | | of the adjoining municipality and no more than thirty (30) miles |
|---|
| 25 | 25 | | from the border municipality, shall be deemed within this state for |
|---|
| 26 | 26 | | the purposes of determining eligibility for funding and financing |
|---|
| 27 | 27 | | under Texas law. Such eligibility includes, but is not limited to, |
|---|
| 28 | 28 | | grants, loans, bonds, and any other financial assistance authorized |
|---|
| 29 | 29 | | under Texas law for municipal or intergovernmental infrastructure |
|---|
| 30 | 30 | | projects and services. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect July 1, 2025, if it |
|---|
| 32 | 32 | | receives a vote of two-thirds of all the members elected to each |
|---|
| 33 | 33 | | house, as provided by Section 39, Article III, Texas Constitution. |
|---|
| 34 | 34 | | If this Act does not receive the vote necessary for effect on that |
|---|
| 35 | 35 | | date, this Act takes effect September 1, 2025. |
