88 relating to agreements between border municipalities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 763.003, Government Code, is amended by
1111 adding Subsections (e) and (f) to read as follows:
1212 (e) An agreement or contract authorized by this chapter may
1313 be memorialized by reciprocal ordinances or ordinances in
1414 substantially similar language enacted by each municipality.
1515 (f) By joint resolution, each municipality may extend the
1616 provisions of this chapter to an agreement or contract that
1717 predates enactment of this chapter.
1818 SECTION 2. Chapter 763, Government Code, is amended by
1919 adding Section 763.006 to read as follows:
2020 Sec. 763.006. ELIGILIBITY FOR FUNDING AND FINANCING
2121 METHODS. Any facility, service, infrastructure, or other real
2222 property created, operated, owned, co-owned, acquired, or governed
2323 by an agreement authorized by this chapter, if located in the state
2424 of the adjoining municipality and no more than thirty (30) miles
2525 from the border municipality, shall be deemed within this state for
2626 the purposes of determining eligibility for funding and financing
2727 under Texas law. Such eligibility includes, but is not limited to,
2828 grants, loans, bonds, and any other financial assistance authorized
2929 under Texas law for municipal or intergovernmental infrastructure
3030 projects and services.
3131 SECTION 3. This Act takes effect July 1, 2025, if it
3232 receives a vote of two-thirds of all the members elected to each
3333 house, as provided by Section 39, Article III, Texas Constitution.
3434 If this Act does not receive the vote necessary for effect on that
3535 date, this Act takes effect September 1, 2025.
