| 13 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 12 | | SECTION 1. Subchapter D, Chapter 551, Government Code, is |
|---|
| 15 | 13 | | amended by adding Section 551.092 to read as follows: |
|---|
| 16 | 14 | | Sec. 551.092. CERTAIN STATE AGENCIES: INTERNAL AUDIT |
|---|
| 17 | 15 | | MATTERS; CLOSED MEETING. (a) In this section: |
|---|
| 18 | 16 | | (1) "Internal auditor" means the internal auditor |
|---|
| 19 | 17 | | appointed for a state agency under Section 2102.006. |
|---|
| 20 | 18 | | (2) "State agency" has the meaning assigned by Section |
|---|
| 21 | 19 | | 2102.003. |
|---|
| 22 | 20 | | (b) This chapter does not require the governing board of a |
|---|
| 23 | 21 | | state agency to conduct an open meeting to: |
|---|
| 24 | 22 | | (1) confer with or receive information from the |
|---|
| 25 | 23 | | agency's internal auditor about a matter the internal auditor |
|---|
| 26 | 24 | | determines would compromise the independence, effectiveness, or |
|---|
| 27 | 25 | | confidentiality of the agency's internal audit function if |
|---|
| 28 | 26 | | disclosed publicly; or |
|---|
| 29 | 27 | | (2) deliberate a matter described by Subdivision (1) |
|---|
| 30 | 28 | | if the agency's internal auditor is present. |
|---|
| 31 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 33 | | Act takes effect September 1, 2025. |
